All persons, partnerships, firms or corporations owning or controlling
land abutting upon any streets or alleys of West Norriton Township
within whose sidewalk area shrubbery or shade trees are growing, the
limbs or branches of which extend over said streets, alleys or their
sidewalks and which interfere with pedestrian or vehicular use or
travel, or which interfere with the public lighting system of the
Township by shading the range of any public lights or touching the
same or the power transmission lines supplying electricity thereto,
are hereby required to trim said shrubbery or trees to a height of
12 feet upwards from said streets, alleys and sidewalks, and, in addition,
in such manner as to prevent them from shading the range of any public
lights or touching the same or the power transmission lines supplying
said lights with electricity, and to remove all dead trees in said
sidewalk area and all dead limbs or branches extending over said streets,
alleys or sidewalks. Where dead trees are removed under the provisions
of this Part 1, the trunks thereof shall be cut off no less than six
inches below ground level or ground down to a level no less than six
inches below ground level.

It is hereby declared to be a public nuisance for persons, partnerships,
firms or corporations owning or controlling land abutting any street
or alley of West Norriton Township within whose sidewalk area shrubbery
or shade trees are growing or upon whose land shrubbery or shade trees
are growing, the limbs or branches of which extend over said streets
or alleys or their sidewalks, or which interfere with the public lighting
system of the Township by shading the range of any public lights or
touching the same or the power transmission lines supplying electricity
thereto, and to fail to remove all dead trees in said sidewalk area
and all dead limbs or branches extending over said streets, alleys
or sidewalks. West Norriton Township may require, by 10 days written
notice, the abatement of such nuisance, in default of which the Township
may cause the same to be done by employees, independent contractors
or the public utility which owns or services said lights and/or power
lines, and collect the cost thereof, together with a penalty of 20%
of such cost, in the manner provided by law for the collection of
municipal claims or by action of assumpsit.

Any person, partnership, firm or corporation violating any of
the provisions of this Part 1 shall forfeit and pay a fine of not
more than $600 to West Norriton Township, the same to be collected
by a proceeding before any District Justice in said Township or recovered
as debts of like amount are now by law recoverable, and in default
of payment of such fine and costs shall be liable to imprisonment
of not more than 30 days in the Montgomery County Prison, and whenever
such person, partnership, firm or corporation shall have been notified
by West Norriton Township through its duly constituted representatives,
or by service of summons or prosecution, or in any other way, that
such violation has been committed, each day that such person, partnership,
firm or corporation shall continue in such violation shall constitute
a separate offense, punishable by a like fine or penalty.
