There shall be in the Town of Kinderhook a bureau known as the
"Recreation Commission."

The Recreation Commission shall be comprised of five members,
three of whom shall be appointed by the Town Board and one of whom
shall be a member of the Hamlet of Niverville. A fourth member shall
be appointed by the Board of Trustees of the Village of Valatie, and
a fifth member shall be appointed by the Board of Trustees of the
Village of Kinderhook. One member shall serve a one-year term, one
member a two-year term, one member a three-year term, one member a
four-year term and one member a five-year term. Determination of which
member shall serve which term shall be by lot. Each succeeding term
shall be for a period of five years.
The appointment of the Commissioners shall be evidenced by a
certificate, in writing, signed by the Supervisor of the Town of Kinderhook
and filed forthwith in the office of the Town Clerk.
The Town Board shall elect a member of the Recreation Commission
to act as its Chairman and a member to act as its Secretary and other
necessary officers to serve for one year. The Commission may adopt
rules and regulations in respect to procedures before it and in respect
to any subject matter of which it has jurisdiction under this chapter.
The Town Board is hereby authorized and empowered to make such appropriation
as it may see fit for expenses for the operation of such Recreation
Commission.
The members of the Commission shall serve without compensation
for their services as such Commissioners.
The Town Board may, at any time, request the Commission to report
at a given time, but no action of the Town Board shall deprive the
Commission of its rights or relieve it of its duty to report at such
time as it deems proper upon any matter at any time referred to it.

A. The purpose of the Recreation Commission is to plan and develop the
recreation programs for the Town of Kinderhook. Programs should provide
a diversity of activities that would appeal to all age groups. The
Commission shall work closely with the Recreation Coordinator in planning
such programs and recommending changes and new programs.
B. The Recreation Commission is hereby invested with all the powers
and duties now or hereafter to be prescribed and set forth in Article
13 of the General Municipal Law and the general statutes of the State
of New York relating to recreation commissions and assistance so far
as the same are applicable and not inconsistent with this chapter.
It shall have the power to coordinate and plan the activities of public
and private agencies devoted in whole or in part to the furtherance
of the equipment, operation and maintenance of playgrounds and neighborhood
recreation centers in the Town of Kinderhook and to undertake and
promote activities and establish, maintain and operate projects devoted
in whole or in part to providing leisure-time activities for persons
in the Town of Kinderhook. The Commission shall not have the power
to expend moneys, but such expenditures shall be made by the Town
Board.
