A. 
Adoption. The Borough Council of the Borough of Tullytown hereby adopts for the purpose of establishing rules and regulations for the maintenance of all structures, including administration, enforcement and penalties, the property maintenance code known as the "International Property Maintenance Code," 2003 Edition, as published by the International Code Council, save and except such portions as are hereinafter deleted, modified or amended, of which three copies have been and are now filed in the office of the Tullytown Borough Council Secretary, and the same are hereby adopted and incorporated as fully as if set out at length herein. From the date on which this article shall take effect, the provisions thereof shall be controlling in the maintenance of all structures, and in all other subjects therein contained, within the corporate limits of the Borough of Tullytown.
B. 
Additions, insertions and changes. The International Property Maintenance Code, 2003 Edition, is hereby amended as follows:

(1) 
A new definition to Section 202 will be added as follows:
"VACANT STRUCTURE. A structure which, if residential, has ceased to be occupied as a residence by any person for a period in excess of 180 days and, if commercial, has ceased to be occupied by any person, firm, or corporation, for a period in excess of 180 days, or is empty by the removal of all machinery, equipment, inventory or merchandise, unless said residential or commercial building is in the process of undergoing repair or renovation, which repair or renovation necessitate the activity of persons in and about the building on at least a weekly basis. A vacant commercial space normally occupied within a building does not apply. The period of 180 days shall begin to run upon notice to the Code official of the vacancy. A structure will not be deemed vacant if it is maintained, with proof it is actively being marketed for sale, same which can include, but not be limited to a real estate brokerage listing."
(2) 
Section 108.2 shall be amended to read as follows: "If the structure is vacant and/or unfit for human habitation and occupancy, and is not in danger of structural collapse, the Code official is authorized to post a placard of condemnation on the premises and order the structure closed up so as not to be an attractive nuisance. Upon failure of the owner to close up the premises within the time specified in the order, the Code official shall cause the premises to be closed and secured through any available public agency or by contract or arrangement by private persons, and the cost thereof shall be charged against the real estate upon which the structure is located and shall be a lien upon such real estate and may be collected by any legal resource."
