[HISTORY: Adopted by the Borough Council of the Borough of Summit Hill 8-1-1977 by Ord. No. 3-1977. Amendments noted where applicable.]
This chapter is adopted in accordance with 8 Pa.C.S.A. § 2708, as amended.
There is hereby created a Recreation Board, which shall be known as "Summit Hill Recreation Commission."

A. 
Composition.
(1) 
Appointment members. The Board shall consist of seven members, who shall be appointed by the Borough Council of Summit Hill. The members shall serve for a term of two years, and the terms of the members shall be staggered in such a manner that beginning in 2004 at least two terms expire annually. Any member may be reappointed to the Board by majority vote of Borough Council. Vacancies on the Board occurring otherwise than by expiration of term shall be filled for the remainder of the unexpired term in the same manner as original appointments. Board members shall serve without pay.

(2) 
Associate members. In addition to appointed members, the Commission shall consist of a member from each organization/group which utilizes any Borough recreational facility. These associate members shall be recommended to the Commission by their respective organization/group and shall once accepted by majority vote of the Recreation Commission serve for a term consistent with the length of the membership in their home organization/group or until such time as removed or replaced by either the Recreation Commission, as set forth herein, or by their home organization/group. Replacements shall be recommended by the respective organization/group, and acceptance by the Recreation Commission shall be by majority vote.
(3) 
Social members. Any other resident of the Borough of Summit Hill shall, upon application and acceptance by majority vote of the Recreation Commission, become social members of the recreation commission, the purpose of which is to assist the Commission in the supervision, operation and organization of any events organized by the Recreation Commission and to assist in the supervision of public recreation places and facilities coming under the control of the Recreation Commission.
(4) 
Changing composition. The number of appointed members of the Recreation Commission shall be changed by the Council of the Borough of Summit Hill, by resolution, upon recommendation of the then-sitting appointed members of the Recreation Commission if it is shown that attempts to fill all appointed members seats have failed and that the powers, duties and responsibilities of the Recreation Commission cannot be fulfilled due to a lack of appropriate number of appointed members or if the powers, duties and responsibilities of the Recreation Commission cannot be filled without increasing the number of appointed members.

B. 
Powers, duties, responsibilities and removal of Commission members.
(1) 
The appointed members of the Recreation Commission shall have the power to supervise and operate public recreation places and facilities as designated by Summit Hill Borough Council and to organize and operate any other recreational events or activities approved and supported by Summit Hill Borough Council. Only appointed members shall be entitled to vote on issues raised by or before the Recreation Commission.
(2) 
Any member, whether appointed, associate or social, may be removed by majority vote of the appointed members of the Recreation Commission if that member misses three consecutive regularly scheduled monthly meetings or the appointed members of the Recreation Commission believe that continued membership in the Commission is not in the best interest of the Recreation Commission. In the event the member subject to removal is an appointed member, the Recreation Commission has only the power to recommend to the Summit Hill Borough Council that this appointed member be removed. Associate or social members may be removed without the approval of Summit Hill Borough Council.

The appointed members of the Recreation Commission shall elect a Chairman and Secretary and all other necessary officers to serve for a period of one year who may serve more than one term if reelected. The Recreation Commission may adopt bylaws, rules and regulations covering its procedure or its operation and conduct of any recreational facilities in the Borough, subject to approval of Summit Hill Borough Council and provided these bylaws, rules and regulations are not inconsistent with federal, state and/or local laws. The Recreation Commission shall hold regular monthly meetings at such times and on such dates and places as it designates at its last regularly scheduled meeting in the year proceeding. The Board may also call special meeting for any relevant purpose it sees fit.

The Recreation Commission shall be responsible for supervising the public parks, play fields and all other outdoor and indoor recreational areas and facilities owned by the Borough of Summit Hill. The Recreation Commission may, as it deems fit and necessary, appoint, without compensation, a Field Chairman, who shall be responsible for overseeing and scheduling any and all events conducted in or on any recreational facility in the Borough.

The Recreation Commission may, on behalf and subject to the approval of Summit Hill Borough Council, apply for, accept or solicit any grants, gifts, bequests or donations of services, equipment, real estate or money from any individual or group to be used as the Borough of Summit Hill deems fit, necessary and appropriate; any grant, gift, bequest or donation of any kind shall become the property of the Borough of Summit Hill.

The Recreation Commission shall have no authority to enter into any contract or incur any obligation binding upon the Borough of Summit Hill without first obtaining the expressed consent of Borough Council. The Recreation Commission, in September of each year, shall submit, in writing, to Borough Council its request for personnel, equipment and/or other material needed for the following year.
The Recreation Board shall make full and complete reports to the governing body at such times as may be designated or requested by the governing body. The fiscal year of the Recreation Board shall conform to that of the Borough of Summit Hill.
