A three-day nonrenewable permit (permit of use) will be required
for conducting a garage sale or yard sale. Permits may be extended
because of inclement weather.
Merchandise bought for the express purpose of resale is prohibited.
There shall be a limit of two separate three-day garage sale,
tag sale or yard sale permits per year.
Sales shall be between the hours of 8:00 a.m. and 5:00 p.m.
only.
The permit is automatically revoked should any Village of Red
Hook police officer, any other police officer empowered by the State
of New York or a Village official state in writing that the garage
sale, tag sale or yard sale is creating an unsafe traffic condition.
The application fee shall be $5.
Local churches, which often hold such sales in their parking
lot, would be affected by this chapter as well, and subject to the
same regulations as private individuals. Local churches would be exempt
from the regulations during community celebrations.
Any person who shall violate any of the provisions of this chapter
shall upon conviction thereof be punishable by a fine not exceeding
$100 or by imprisonment for a term not exceeding 15 days for each
violation.
As used in this chapter, the following terms shall have the
meanings indicated:
GARAGE SALES, YARD SALES and TAG SALES (or any other names of
such sale)
Permitted hereunder are those sales of household and personal
articles owned, possessed, maintained or controlled by the resident,
which will allow neighbors to participate in the sale without being
subject to arrest. Sales should be confined to the area within the
lot lines and back of the sidewalk, or if there is no sidewalk, at
least 10 feet back street line.
Three temporary freestanding signs on stakes may be posted on
the dates of the sale, subject to the following conditions:
A. Each sign shall not exceed six square feet.
B. Each sign shall be removed at the end of the day.
C. Signs are not to be placed on any telephone poles, sign posts or
street signs of any kind.
