The purpose of this article is to protect the health, safety
and welfare of all those residing within the Township. It is further
the purpose of this article to prevent the needless health hazard
caused by dog feces upon public and certain private properties.
No person owning, harboring, keeping or in charge of any dog
shall cause, suffer or allow such dog to soil defile, defecate on
or commit any nuisance on any common thoroughfare, sidewalk, passageway,
bypass, play area, park or any place where people congregate or walk,
or upon any public property whatsoever or upon any private property
without the permission of the owner of said property. Restrictions
in this section shall not apply under the following conditions:
A. The person who owns or harbors the dog shall immediately remove all
feces deposited by such dog by any sanitary method approved by the
local health authority.
B. The feces removed from the aforementioned designated area shall be
disposed of by the person owning, harboring, keeping or in charge
of said dog in a sanitary manner approved by the local health authority.
Any person who violates any one or more provisions of this article
shall be subject to a fine of not more than $500 for each separate
offense and/or confinement in the Ocean County Jail for a period of
not more than 90 days. In the case of a continuing violation or violations,
a fine of not more than $500 may be assessed for each day that said
violation or violations are not corrected. A separate offense shall
be deemed committed on each day during or on which a violation occurs
or continues.
