The purpose of this article is to protect the health, safety
and general welfare of the citizens of the Township of Jackson as
well as to provide for the safety and health of horses and similar
livestock by requiring the fencing of horses and similar livestock.
In any zone in the Township of Jackson wherein the keeping of
horses, ponies or other livestock is allowed, the following regulations
shall be complied with:
A. Construction. In all cases, fences must be provided for the keeping
of horses, ponies or other livestock so as to prevent their escape.
Fences must be constructed of such materials and in such a manner
as to prevent and preclude said escape.
B. Permits.
(1) The application for a building permit for a fence to pen horses or
similar livestock must include, in addition to any other information
required for a building permit, the height, the span between fence
posts, a sketch of the proposed fence, the type of material to be
used and whether same has been treated.
(2) The Building Inspector shall issue a building permit for any such
fence only when the proposed fence shall adequately prevent the escape
of horses.
C. Maintenance. All fences, pens, stables or similar structures must
be adequately maintained in a state of repair to prevent the escape
of horses, ponies or other livestock.
For any and every violation of the provisions of this article,
the owner of said premises where such violation has been committed
or shall exist or the tenant of such premises where such violation
has been committed or shall exist or any other person who commits,
takes part in, or assists in such violation or who maintains any building
or premises in which any such violation shall exist shall, for each
and every day that such violation continues, be subject to a fine
of not more than $500 or be imprisoned in the county jail for a term
not exceeding 90 days, or both.
