The purpose of this chapter is to regulate and control trailers
and mobile homes occupied as dwellings, pursuant to the authorization
contained in N.J.S.A. 40:52-1, and to remedy and clarify the existing
situation in the Township of Jackson for the purpose of removing and
phasing out illegal trailers and establishing reasonable regulations
and registration requirements for legal trailers and mobile homes.
It shall be unlawful within the limits of the Township of Jackson for any person to park or locate any trailer or mobile home on any street, alley or highway or other public place or on any tract of land, occupied or unoccupied, owned by any person, within the Township of Jackson, in the County of Ocean, except as provided herein and as provided in Chapter
280, Mobile Home Parks, and Chapter
400, Trailers and Campsites, of the Code of the Township of Jackson.
Any mobile home or trailer located on any street, alley or highway
or other public place or on any tract of land owned by any person,
for the purpose of occupancy as a dwelling within the Township of
Jackson, shall be permitted to remain or shall be removed in accordance
with the following:
A. Any mobile home or trailer which has been located on such public place or tract of land on or before September 16, 1959, and has been continuously occupied since that date shall be permitted to remain in that location, provided the owner of said mobile home or trailer complies in full with the requirements of this chapter and specifically, with the requirements of §§
285-5 and
285-6 hereof, and provided further that such mobile home or trailer is not being used for rental purposes.
B. Any mobile home or trailer which has been placed on such public place or tract of land and has been occupied subsequent to September 16, 1959, but prior to January 1, 1973, shall be permitted to remain in that location for a period not to exceed 10 years from the date hereof, provided the owner of said mobile home or trailer complies in full with the requirements of this chapter and, in particular, complies with the provisions of §§
285-5 and
285-6 hereof, and provided further that such mobile home or trailer is not being used for rental purposes; provided, however, that the original owner or owners, listed on the application form submitted pursuant to §
285-6, of any mobile home or trailer which falls within the classification of this section shall be permitted to continue to reside in and use such mobile home or trailer as a dwelling on an indefinite basis after the expiration of the aforesaid ten-year period.

C. Any mobile home or trailer which has been placed on a location on
any street, alley or highway or other public place or on any tract
of land owned by any person, for the purpose of occupancy as a dwelling
within the Township of Jackson, on or after January 1, 1973, shall
be required to be removed within six months of the effective date
hereof; and it shall be unlawful within the limits of the Township
of Jackson for such a mobile home or trailer to be parked or located
on any street, alley or highway or other public place or on any tract
of land owned by any person for such occupancy within the Township
of Jackson after the termination of said six-month period.
D. Any mobile home or trailer which has been placed on such public place or tract of land and has been used for business purposes subsequent to September 16, 1959, but prior to January 1, 1973, shall be permitted to remain on that location and to be used in connection with such business for a period not to exceed 10 years from the date hereof, provided that the owner of said mobile home or trailer complies in full with any applicable requirements of this chapter, and provided further that the owner of such mobile home or trailer files the registration information required by §
285-6 within 90 days of the date of adoption of this provision.

By duly adopted resolution, the Township Committee may permit any owner of real property to locate a mobile home or trailer on such property for a period not to exceed six months, in the discretion of the Township Committee, where such owner establishes to the satisfaction of the Township Committee that there exists a hardship situation, as defined herein. As used herein, the term "hardship situation" is defined as a situation where the aforesaid owner of such real property has had his dwelling and residence located on such property substantially destroyed by flood, fire or other similar destructive occurrence and where such owner has available no other place of dwelling or residence. In all such situations, the standards, registration requirements and licensing fees set forth in §§
285-5,
285-6 and
285-7 of the Jackson Code shall apply.
Any mobile home or trailer permitted or allowed to continue in its present location for occupancy as a dwelling, under the provisions of §
285-3, shall comply in all respects with the following requirements:
A. Said mobile home or trailer shall be located on a well-drained, properly
graded site, free from stagnant pools of water.
B. Any such mobile home or trailer shall be connected to an approved
water supply system to supply running water for all sanitary and washing
fixtures, and drinking and domestic purposes, as required by all applicable
laws, ordinances and regulations.
C. Any such mobile home or trailer shall be connected to an approved
septic system or sanitary sewer system, in accordance with all applicable
laws, ordinances and regulations.
D. Electrical service to the mobile home or trailer shall be of adequate
capacity to serve the maximum connected load. Main service, fusing
and distribution shall comply with the applicable requirements of
the Electrical Code and shall be installed and maintained in accordance
with applicable laws, ordinances and regulations.
E. Mobile home units shall have a minimum floor area, inclusive of kitchen,
bath and closet area, of 140 square feet when occupied by not more
than two persons, and not less than 240 square feet when occupied
by three persons, with an additional 70 square feet per person when
occupied by more than three persons. The minimum height of habitable
spaces in mobile homes and trailers shall not be less than seven feet.

F. Any mobile home or trailer located in the Township of Jackson must
be maintained in a state of repair, free of leakage and free of access
by rodent or insect infestation or the like.

A. An individual trailer campsite license fee of $3 per week per trailer
or mobile home shall be paid to the Township of Jackson by the owner
or occupant thereof, which sum shall be paid monthly on or before
the last calendar day of each month. In addition, all real estate
taxes shall be paid up to date on the premises upon which the mobile
home or trailer is located. This individual trailer campsite license
fee shall commence on October 1, 1976. Where an individual mobile
home or trailer is located on premises qualified for a license under
this chapter and the owner pays the aforesaid license fee, said mobile
home or trailer is hereby declared to be personal property and shall
not be subject to assessment as real property.
B. This fee does not apply to the owner or occupant of a mobile home or trailer located within the confines of a mobile home park as defined or licensed under Chapter
280, Mobile Home Parks, of the Code of the Township of Jackson.
Any person who violates any provision of this chapter shall,
upon conviction thereof, be punished by a fine up to but not exceeding
$500 or by imprisonment for a term up to but not exceeding 90 days,
or both, in the discretion of the Municipal Judge. A separate offense
shall be deemed committed for each day during or on which a violation
occurs.
