A grading and/or building permit shall not be issued for any parcel or lot unless an erosion and sediment control plan has been approved by the Cecil Soil Conservation District and a stormwater management plan has been approved by the Cecil County Department of Public Works as meeting all the requirements of the Design Manual and this chapter. A grading and/or building permit may not be issued without:
A. 
Recorded easements for the stormwater management facility and easements to provide adequate access for inspection and maintenance from a public right-of-way;
B. 
A recorded stormwater management inspection and maintenance agreement and beneficial users plan as described in § 325-25 of this chapter;
C. 
A performance bond as described in § 325-20 of this chapter; and
D. 
Recorded easements from adjacent property owners if runoff is redirected off of the site, inclusive of stormwater management BMP outfalls and outfalls to tidally influenced waters or wetlands.
A nonrefundable fee will be collected at each phase of the stormwater management plan review and approval process. The fee will provide for the cost of plan review, administration, and management of the approval process. A fee for inspection of all projects subject to this chapter will be required prior to final approval of the stormwater management plan. All fees shall be in accordance with the fee schedule adopted by the County, as may be amended from time to time.
Any grading permit issued by the Department of Public Works and any building permit which requires Department of Public Works review and/or approval may be suspended or revoked. The Department of Public Works may suspend the review of a plan currently under review and/or require revisions to a plan previously approved. None of the above actions shall be taken by the Department until after written notice is given to the permittee for any of the following reasons:
A. 
Any violation(s) of the conditions of the stormwater management and/or erosion and sediment control plan approval.
B. 
Changes in site runoff characteristics upon which an approval was granted.
C. 
Construction is not in accordance with the approved plan or permit.
D. 
Noncompliance with the notice of violation(s) or stop-work order(s) issued for the project/site.
E. 
An immediate danger exists in a downstream area in the opinion of the Department of Public Works.
In granting the plan approval for any phase of the stormwater management plan review and approval process, the Department of Public Works may impose such conditions as may be deemed necessary to ensure compliance with the provisions of this chapter and the preservation of the public health and safety.
