A. 
Limitation of terms. The limitation of legislative terms will be as follows:
(1) 
Supervisor: limit of four full terms in office or eight years, whichever is less.
(2) 
Councilman or Councilwoman: are limited to two full terms or eight years, whichever is less.
B. 
Exceptions.
(1) 
Appointees to a vacancy on the Town Board or Town Supervisor. The time served as an appointed position to a vacancy on the Town Board or as Supervisor will not be considered a "term in office." No Town Board may reappoint an individual to the same position.
(2) 
Temporary appointments. Any individual who fills a temporary vacancy of the Town Supervisor due to illness will not be considered as filling a "term in office."
C. 
Prohibitions and exclusions.
(1) 
Terms previously held. Any Councilman or Town Supervisor is prohibited from seeking a term he or she has previously held until a break in service of one full term for the respective office is completed, e.g., Supervisor must wait two years before running for Supervisor. Similarly, a Councilman must wait four years upon completion of his or her time before running for Councilman.
(2) 
Running for other Town Board positions. A Councilman may run for Supervisor upon completion of his or her allowed term limits. Conversely, a Supervisor may run for a Councilman position upon completion of his or her term.
(3) 
Fulfill vacancy. No former Supervisor or Councilman may be appointed to fulfill a vacancy until he or she has met a full break in service.
D. 
Definitions. As used in this article, the following terms shall have the meanings indicated:
APPOINTED TERM
Period of time which an individual is appointed to, to fill a vacancy and is less than one year or to the next election, whichever comes first.
BREAK IN SERVICE
Period of time which is equivalent to one "term" in an individual's specific office. During this period, an individual may not run, fulfill or be appointed to an office which he or she has previously held.
COUNCILMAN OR COUNCILWOMAN'S TERM
Four years.
SUPERVISORS TERM
Two years.
TEMPORARY TERM
A short period of time, six months or less, to which a person may be appointed to fill a vacancy due to illness or death.
TERM IN OFFICE OR TERM
Period of time defined by law as the duration of time allowed for an individual to serve before he or she must seek re-election to their specific office; e.g., Councilman: four-year "term."
This article shall take effect immediately upon its filing in the office of the Secretary of State in accordance with the provisions of § 27 of the Municipal Home Rule Law; however, the foregoing notwithstanding, this article is subject to mandatory referendum pursuant to the terms of § 23 of the Municipal Home Rule Law.[1]
