Under the provisions of the Connecticut General Statutes, the
Town may make provision to enter into or upon any land to correct
the flow of surface water through watercourses which prevent the free
discharge of municipal highway surface water through said courses.
Persons authorized to construct or repair highways may make or clear
any watercourse or place for draining off the water therefrom into
or through any person's land as far as is necessary to drain
off such water. No one shall erect any dwelling or other building,
or create any yard, or place any goods or merchandise or place any
obstruction in the way of the free discharge of surface water through
established watercourses without first obtaining written permission
from the Selectmen.
Should any relocation or extension of a culvert or watercourse
be necessary, the expense of such relocation or extension shall, unless
otherwise agreed upon by the Selectmen, be borne by the property owner
requesting the change.
Should any obstruction be illegally placed in the way of draining
off surface and highway water, the Selectmen shall cause to have the
obstruction removed. The person, firm or corporation responsible for
placing the obstruction may be assessed the costs of the removal.
