This chapter shall be known and may be cited as the "Parks Law of the Village of Baldwinsville."
The rules and regulations as set forth herein shall apply to and be in effect in all parks under the control, supervision and jurisdiction of the Village of Baldwinsville.
The following terms shall have the meanings indicated in this section:
PARK or PARKS
Includes all parks, playgrounds, commons or other recreational areas, together with all buildings and appurtenances therein or thereon, under the control, supervision and jurisdiction of the Village of Baldwinsville and which now or hereafter may be maintained, operated or used by the Village as part of its public park system.
PERMIT
Any written license issued by or under the authority of the Village Clerk, permitting the performance of a specified act or the conduct of a particular function, program or activity.
PERSON
Any individual, firm, partnership, corporation or association of persons, and the singular number shall include the plural.
VEHICLE
That defined in § 159 of the Vehicle and Traffic Law of the State of New York.
VILLAGE BOARD
The Board of Trustees of the Village of Baldwinsville.
No person shall operate any vehicle or bicycle at a speed in excess of 15 miles per hour in any part or portion of the park system.

All parks shall be open only from the hours of 8:00 a.m. to sunset, local time, every day of the week.

There shall be no swimming in any park.

Softball and hardball shall be permitted to be played only in designated areas of parks.

No golf shall be played in any park at any time.

There shall be no fires in any park, except for charcoal grill fires in designated areas.

There shall be no overnight camping in any park.

The Village shall not be responsible for any lost or stolen items of any kind from persons who use the parks.

There shall be no business or commercial ventures or enterprises, however known, allowed in the parks without a permit.

A. 
The term "dog" shall mean a male or female member of the species Canis familiaris. The term "owner" shall mean any person(s) who owns, has custody of or has under his/her immediate supervision or control a dog.
B. 
The owner of any dog in a park shall, by suitable means, pick up any dog defecation immediately after and before leaving the site of such defecation and properly dispose of same.
C. 
The Board of Trustees is hereby authorized by resolution to prohibit dogs in any park or part thereof and to post/sign such prohibition accordingly.
D. 
All of the provisions of Chapter 112, entitled "Animals," of the Code of the Village of Baldwinsville shall be applicable in all Village parks, and the restrictions set forth in this section shall be in addition to and not instead of said Chapter 112.
A. 
No person shall be permitted to operate or park any vehicle or bicycle on any playing field, flower bed, garden, grass, seeded area or vacant area in any part or portion of the park system, except for those vehicles operated or parked in the course of duty by police, fire, emergency medical, rescue or park maintenance personnel. Such vehicles or bicycles may be operated only on the driveway or parking areas of such parks and may stand or be parked only in the areas designated for standing or parking.
B. 
Operation of motorized recreational vehicles. No person shall operate motorcycles, minibikes, dirt bikes, mopeds, snowmobiles or any other motorized recreational or passenger vehicle as defined in New York Vehicle and Traffic Law § 159, in Village parks, except upon paved roadways.

C. 
No person shall operate an unregistered vehicle at any time in a park.

No person shall bring or ride any horse or pony in any part or portion of the park system which is not specifically designated as a bridle path.

No person shall bring into or leave in any Village park any glass bottle or glass container.

No person, except duly sworn law enforcement officers, shall have or carry, whether concealed or not concealed on his or her person, any gun, revolver, pistol or other firearm, or any air gun, spring gun or other instrument or weapon in which the propelling force is a spring, gas or air, or any bow and arrow within any Village park.

No person shall bring into or have any explosive or explosive substance within any Village park (except by permit, i.e., fireworks).

The launching, storage or use of privately owned boats, canoes, outboards, rafts, flats or any kind of hand- or power-propelled craft on any park waters is prohibited, except in designated areas.

No person shall deposit any garbage, refuse, waste, foodstuff, paper or other litter or noxious material in any part of a Village park nor shall any person bring into a Village park any garbage or refuse for the purpose of disposing of such garbage or refuse within the park.

A. 
The consumption, distribution or sale of alcoholic liquors or beverages, including beer or wine, and the bringing of such items into any park is hereby prohibited, except when a permit has been granted by the Village Clerk.
B. 
The Village Clerk shall not grant such a permit as authorized in Subsection A above unless satisfactory proof of liability insurance is presented to the Clerk, in an amount to be determined by the Clerk, by the person requesting such permit to consume alcohol in a park.
Permits to use any park in a manner otherwise than as restricted by the provisions of this chapter may be granted by the Village Clerk, provided that:
A. 
A person shall apply for a permit prior to the date or dates of use requested.
B. 
An application shall be filed with the Village Clerk.
C. 
The proposed use of the park will not unreasonably interfere with or detract from the general public's use and enjoyment of such park.
D. 
The proposed use will not unreasonably interfere with or detract from the promotion of the public health, safety and general welfare of the residents of the Village.
E. 
The proposed use is not reasonably anticipated to incite violence, crime or disorderly conduct.
F. 
The proposed use will not entail unusual, extraordinary or burdensome expense to the Village.
G. 
A refundable deposit, if required by the Village Clerk, is posted as security.
H. 
A certificate of liability insurance is deposited with the Village Clerk, if required by the Village Clerk.
A. 
A permittee shall be bound by all other park rules and regulations not varied by such permit and all applicable ordinances or local laws as fully as though the same were inserted in said permit.
B. 
The permit shall cover use of the described site only and shall not include permission to use any other area of any park.
C. 
The person to whom a permit is issued shall be liable for any loss, damage or injury sustained by any person whatever by reason of negligence of the person to whom such permit has been issued.
The Village Clerk or any Village police officer shall have the authority to revoke any permit upon finding a violation of such permit or of any rule or regulation or ordinance or law not varied by such permit.
Any person convicted of violation of this chapter shall be subject to a fine not to exceed $250.
