A. 
For the purpose of promoting the health, safety, security, morals and the general welfare of the community, the Planning Commission, by consent of the Mayor and Council, will propose requirements for height and size of buildings, the type of construction of buildings, yard spaces for buildings, the density of population, the location and use of buildings, and the use of land for trade, industry, residence and other uses as provided in this Code.
B. 
The Planning Commission shall consist of five members and one alternate. The alternate may sit on the Commission in the absence of any member of the Commission. When the alternate is absent, the Mayor and Council may designate a temporary alternate to sit on the Commission. Four members and the alternate of the Commission shall be appointed by the Mayor, subject to confirmation by the Council. The terms of all members and the regular alternate shall be five years or until their successors take office. The remaining member shall be appointed by the Mayor and Council from among its members.

C. 
The term of the member appointed by the Council shall be for nine (9) months, or until another member of the Council is appointed. However, in the event the member's term as a member of the Council terminates, the member's term as a member of the Planning Commission shall terminate at the same time. A vacancy occurring prior to the expiration of the term for which a member of the Commission is appointed shall be filled in a like manner for the remainder of the unexpired term for which their predecessor was appointed. The four members of the Commission appointed by the Mayor shall serve without compensation. The member appointed by the Council from its own membership shall serve without additional compensation.

D. 
The Commission shall elect a Chairman from among the members appointed by the Mayor. The term of the Chairman shall be one year with eligibility for reelection.
E. 
The Commission shall have the powers and duties provided for in Article 66B of the Annotated Code of Maryland [1988 replacement volume], as now or hereafter amended.

A. 
For the purpose of promoting the Town as a "Tree City" and for establishing regulations for the proper planting, care, and maintenance of trees in public places, the Tree Committee shall submit an annual Town Tree Plan to the Mayor and Council.
B. 
The Tree Committee shall consist of four members. Three members shall be citizens and residents of the Town who shall be appointed by the Mayor with the approval of the Council. One member shall be a member of the Mayor and Council, appointed by the Mayor and Council. The member of the Mayor and Council serving on the Tree Committee shall be a voting member.
C. 
The term of office of each member, except the Councilmember, shall be three years. The term of the member of the Mayor and Council serving on the Tree Committee shall be one year. However, if the Mayor/Councilmember is no longer serving in that capacity, then such member's term on the Tree Committee shall end. In the event that a vacancy shall occur during the term of any member, a successor shall be appointed by the Mayor with the approval of the Council for the unexpired portion of the term. The Mayor and Council shall name the Chairman.
D. 
Members of the Committee shall serve without compensation.
E. 
The Committee shall make its own rules and regulations and keep a journal of its proceedings. A majority of the members shall be a quorum for the transaction of business.
F. 
It shall be the responsibility of the Committee to study, investigate, counsel, develop and/or update annually, and administer a written plan for the care, preservation, pruning, planting, replanting, removal or disposition of trees and shrubs in parks, along streets and in other public areas. Such plan will be presented annually to the Mayor and Council and, upon their acceptance and approval, shall constitute the Official Comprehensive Town Tree Plan for the Town of Galena, Maryland. The Committee, when requested by the Mayor and Council, shall consider, investigate, make findings, report and recommend upon any special matter of question within the scope of its work.
G. 
The Mayor and Council may, by resolution, cross-designate the membership of the Tree Committee to also serve as the Parks and Recreation Committee so that the membership of the Tree Committee and the membership of the Parks and Recreation Committee are the same. If such cross-designation is made, the Tree Committee and the Parks and Recreation Committee may hold combined meetings.

They shall make recommendation to the Mayor and Council for the expenditure of any moneys appropriated or raised by other means to help operate the park facilities.

The Mayor and Council may, by resolution, cross-designate the membership of the Tree Committee to also serve as the Parks and Recreation Committee so that the membership of the Tree Committee and the membership of the Parks and Recreation Committee are the same. If such cross-designation is made, the Tree Committee and the Parks and Recreation Committee may hold combined meetings.
