This article is enacted pursuant to Municipal Home Rule Law
§§ 10(1)(ii)(a)(1) and 10(1)(ii)(d)(3) and is intended
to supersede Town Law § 23(1), Public Officers Law § 3(1),
and any previously enacted provisions dealing with residency of Town
officers and commissioners and deputy commissioners contained within
this Town Code.
A.
Notwithstanding
any inconsistent provision of any state or local law heretofore enacted,
every officer of the Town of Brookhaven shall be at the time of her
or his appointment and throughout that term of office an elector and
resident of the County of Suffolk or the County of Nassau.
B.
This shall
not apply to an elected official, or her or his deputies, who must
be an elector and resident of the Town of Brookhaven at the time of
her or his election or appointment and throughout that term of office.
