Pursuant to Section 10 of the Municipal Home Rule Law which
authorizes local governments to adopt laws in relation to the government,
protection, order, conduct, safety, health and well-being of the persons
and property therein which are not inconsistent with the Constitution
or any general laws, hereby establishes the position of part-time
Village Constable within the Village of Pleasantville, and the Board
of Trustees is authorized to appoint as many part-time Constables
as it may, from time to time, deem necessary.
No person shall be appointed to the position of part-time Constable
of the Village of Pleasantville unless said person has been designated
to serve as a court attendant. Part-time Village Constables shall
and must serve as court attendants when directed to do so. Part-Time
Constables of the Village of Pleasantville shall be peace officers
as defined by the Criminal Procedure Law.
Part-time Constables of the Village of Pleasantville shall,
in civil matters, in accordance with the provisions of Section 110,
Subdivision (a) of the Uniform Justice Court Act, perform the same
duties as performed by sheriffs in courts of record and shall have,
within their territorial jurisdiction and subject to any limitations
imposed by law or by the rules, such power to serve and execute the
processes and mandates of the court as a sheriff has with regard to
the processes and mandates of the Supreme Court.
All applicants for the position of part-time Constable of the
Village of Pleasantville shall submit to a background investigation
to be conducted by the Chief of Police of the Village of Pleasantville,
and no appointment to the position of part-time Constable shall be
made until such background investigation shall be completed and a
report thereof made to the Board of Trustees.

All persons appointed to the position of part-time Village Constable
shall successfully enroll in and complete the mandatory training program
prescribed by the Municipal Police Training Council and any other
training program as may hereafter be required by the Chief of Police
of the Village of Pleasantville, the Board of Trustees or the State
of New York. A newly appointed Part-Time Constable of the Village
of Pleasantville shall enroll in the first available training program
offered by the Municipal Police Training Council immediately after
his or her appointment. No person appointed as a peace officer shall
exercise the powers of a peace officer unless he or she has received
such certification within 12 months of appointment.
The Village of Pleasantville by this article and pursuant to
its home rule authority, waives any and all Village residency requirements
for the position of part-time Constable. Part-time Constables shall
only be required to be residents of Westchester County as a condition
precedent to employment.
