A. 
Permits must be obtained for all swimming pools at the time they are first erected.
B. 
For pools already in use, permits must be obtained or applied for within two weeks of the effective date of this chapter.
(1) 
In-ground pools already in use do not need additional permits since they are covered by their original building permit.
(2) 
All aboveground pools need permits.
C. 
The permit fee for all aboveground pools shall be as set forth in the current Fee Ordinance as contained in Chapter 92, Fees.[1]

D. 
The permit fee for new in-ground pools is based on the building permit fee schedule.
E. 
Pools less than 18 inches deep are exempt.
F. 
Plastic wading pools that are emptied when not in use are exempt.
A. 
Pools must be located:
(1) 
Not less than six feet from any property line.
(2) 
Not less than 10 feet back from the rear building line.
(3) 
Not less than 15 feet back from the front building line.
(4) 
At least 10 feet from any overhead electric power lines (telephone lines are excluded).[1]

B. 
If pools are connected to any utility line, a separate valve must be installed.
C. 
All pools must have approved filtration systems and circulators.
D. 
Generally.
(1) 
Outdoor lighting shall be shielded from neighbors' property.
(2) 
Pools shall not be drained into adjoining land.
(3) 
Location shall be such as to minimize any nuisance.
A. 
Fencing.
(1) 
For below-ground pools, fences shall be five feet high.
(2) 
For aboveground pools, fences shall be four feet high.
(3) 
Acceptable fences are chain link, stockade, solid wood or pickets not exceeding one-and-one-half-inch spacing.
(4) 
Any other type fence, including living fences, must be inspected and certified by the Code Enforcement Officer.
(5) 
Fences erected prior to the effective date of this chapter must be inspected and certified by the Code Enforcement Officer. Any fence already erected, but not in conformity, can be accepted at the discretion of the Code Enforcement Officer.
(6) 
All fences must be located at least six feet from the water's edge.
(7) 
All gates must be provided with a lock located at the top of the gate.
(8) 
One side of the fence, preferably the street side, shall be of an open-type fence.
(9) 
During excavation, the pool area must be fenced in a manner approved by the Code Enforcement Officer.
(10) 
Pools of new design having self-contained fences shall be inspected by the Code Enforcement Officer, who shall have the right to waive any of these regulations which he or she feels are not applicable.
B. 
Pool safety.
(1) 
First aid lifesaving equipment, such as ring buoys, grab poles, etc., must be available.
(2) 
The depth of the pool must be marked.
(3) 
Ladders on aboveground pools must be removed when not in use.
(4) 
A record of pool sanitation activities must be kept.
(5) 
A safety net or pool cover must be used during the off-season if the pool is not emptied.
Any person who shall violate any of the provisions of this chapter shall, upon conviction, be subject to a fine or penalty of not more than $600, plus the costs of prosecution, and, in default of payment thereof, to imprisonment for not more than 30 days in jail. Each day's continuance of violation shall constitute a separate offense.
