The Planning Board, in its discretion, is hereby empowered to approve cluster-type subdivisions, when permitted under Chapter 200, Zoning, of the Code of the Town of Porter. Such subdivisions shall conform with § 200-21, Cluster developments, of Chapter 200, Zoning.
A. 
The Planning Board may waive the requirements for subdivision improvements if, in its judgment of the special circumstances of a particular plat or plats, they are not requisite in the interest of the public health, safety and general welfare.
B. 
The Planning Board may also waive the requirements for such subdivision improvements if, in its judgment of the special circumstances of a particular plat or plats, they are inappropriate because of inadequacy or lack of connecting facilities adjacent to, or in proximity to the subdivision.
C. 
No such modification(s) may be granted if it/they would have the effect of nullifying the intent and purpose of Chapter 200, Zoning, the Comprehensive Land Use Plan, or this chapter.
D. 
In granting waivers or modifications, the Planning Board may require such reasonable modifications as will, in its judgment, substantially secure the objectives of the standards or requirements so waived or modified.
