A. 
Pursuant to the provisions of N.J.S.A. 40A:9-139, there is hereby created the office of Municipal Attorney in and for the Township of Buena Vista.
B. 
The Municipal Attorney shall be appointed by the Township Committee for a term of one year.
C. 
The annual retainer of the Municipal Attorney shall be as fixed in the Salary Ordinance,[1] with additional fees for legal services to be approved by the Township Committee.

The Municipal Attorney shall have such powers and perform such duties as are provided for his office by general law or the ordinances of the Township of Buena Vista. He shall, unless otherwise directed by the Township Committee, represent the Township in all judicial and administrative proceedings in which the Township may be a party or have an interest, and shall, at the direction of the Township Committee, represent its elected and appointed officers, departments and agencies in judicial and administrative proceedings in which they shall be a part or have an interest. He shall give all legal counsel and advice where required by the Township Committee or any member thereof and shall, in general, serve as the legal advisor to the Township Committee on all matters of Township business.
All original copies of papers, documents, memoranda, reports and all other materials relating to the administration of the legal duties of the Municipal Attorney shall be and remain the property of the Township. Upon the termination of his services with the Township, the Municipal Attorney shall forthwith surrender to any successor all such property at no cost, together with a written consent to the substitution of any successor in all legal actions and proceedings then pending to which the Township is a party.
