This article is intended to require a mandatory hookup for buildings or structures located on streets where the municipality's water system is currently constructed; and mandatory hookup for those buildings or structures which are located in the area of any proposed expansion of the municipality's water supply system.

As used in this article, the following terms shall have the meanings indicated:
AVAILABILITY OF WATER SUPPLY SYSTEM
The water supply system constructed or to be constructed by the Borough of Buena Municipal Utilities Authority shall be deemed to be available to a building or structure when a water main is installed along the frontage of the lot on which said building or structure is located, provided that the building or structure is within 200 linear feet of the water main running along the frontage of such lot, and connecting such building or structure is practical pursuant to N.J.A.C. 7:10-12.4(C)1.

BUILDINGS or STRUCTURES
Dwelling houses, commercial and industrial structures located on a street or road in the Township of Buena Vista which may be occupied or used by human beings.
PUBLIC WATER SUPPLY SYSTEM
The water supply system constructed and operated by the Borough of Buena Municipal Utilities Authority.
A. 
The owner of every existing building or structure, and the owner of every building or structure which may be hereafter constructed or acquired in the Township of Buena Vista, shall, within 90 days after the date on which the water supply system constructed by the Borough of Buena Municipal Utilities Authority is made available to said building or structure, connect and hook up said building or structure to the water supply system.
B. 
In addition to those areas in the Township of Buena Vista which are currently serviced by the Buena Borough's water supply system, this article shall require the mandatory hookup of all buildings or structures and sealing of wells located on properties hereinafter set forth, which are a part of the Route 40 and Route 54 water main extension project, which begins approximately 600 feet north of Fursin Avenue, along Route 54 and continues south to the intersection of Route 54 and Route 40 and Route 54 down Fursin Avenue to the end and is comprised of the following properties:

(1) 
Block 4001, Lots: 1 to 22.
(2) 
Block 4001, Lots: 25 to 41.
(3) 
Block 4001, Lots 45 to 51.
If the owner of any building or structure referred to in § 292-3 shall fail to connect such building or structure within 90 days after the water supply system becomes available to such lots, the Township may proceed to make such connection or cause the same to be made and assess the cost thereof as a lien against such property pursuant to and in accordance with the provisions of N.J.S.A. 40A:31-12.
All privately owned water wells utilized by any building or structure which connects to the water supply system constructed and operated by the Borough of Buena Municipal Utilities Authority shall be dismantled and permanently sealed in accordance with the requirements of N.J.A.C. 7:9D-1.1 et seq. within 90 days of the date that centrally supplied water service becomes available to such building or structure; provided, however, that this requirement shall not apply to any privately owned water well that is devoted exclusively to irrigation for agricultural or horticultural purposes.

Any person, association or corporation who shall fail to comply with this article within 90 days after notice by the Clerk of the Township of Buena Vista shall, upon complaint in the Buena Vista Township Municipal Court, be punishable as provided in Chapter 1, General Provisions, § 1-15, for each day of delay after the expiration of the 90 days in which the provisions of the notice are not complied with. The penalties in this section shall apply regardless of whether the property is titled in the name of one or more individuals, a partnership, corporation, a limited liability company or in some other legal entity.
