Except as expressly modified by the terms of this article, the provisions of Articles I, III, IV, V, VII and VIII of this chapter shall apply to the Joppa Area Sanitary Subdistrict.
A. 
A recoupment fee shall be paid for any property within the Joppa Area Sanitary Subdistrict or for any optional property allowed to be provided service from the subdistrict at the time all other hook-up or connection charges are paid to the County. The fee shall be as follows:
(1) 
Residential dwelling units which were existing or for which building permits had been issued as of the date of execution of an off-site utility recoupment agreement for the Gunpowder Subdivision incorporating the terms of this act ("off-site agreement date"): $1,167 per unit.
(2) 
Residential dwelling units for which building permits are issued after the off-site agreement date: $2,334 per unit.
(3) 
Existing or future non-residential connections (business and industrial uses): $16,171 per acre.
B. 
The recoupment fees for non-residential connections shall be calculated using the total acreage of the lot or parcel as recorded in the land records of Harford County on the off-site agreement date minus any road right-of-way or road improvement right-of-way and minus any portion of the property which the county deems to be outside of the subdistrict. If the entire lot or parcel is zoned business or industrial, a recoupment fee for the entire lot or parcel shall be due at the time of the first non-residential connection for business or industrial use for the lot or parcel or any portion thereof.
C. 
Any property zoned business or industrial but having a residential use located upon it shall be permitted to pay the applicable fee for a residential use; however, if the property is thereafter converted to a business or industrial use, an additional payment shall be required and shall be calculated as described in § 256-120B except that a credit shall be given in the amount of any residential recoupment fee previously paid.
D. 
Properties which have split zoning, i.e. both residential and business or industrial, shall pay the applicable residential recoupment fee at the time of residential connection and shall pay the non-residential recoupment fee for the entire acreage zoned business or industrial at the time of the first non-residential connection.
E. 
Fees for properties with non-residential uses which existed or for which a building permit had been issued on or before the off-site agreement date that are zoned other than business or industrial shall be calculated according to the fixture count method described in the County's water and sewer rules and regulations, as amended, and charged one existing residential recoupment fee for every 30 fixture unit values.
F. 
For purposes of determining the applicable recoupment fee, the zoning in place at the time of application for connection shall be used.
G. 
Where a property zoned business or industrial is split by the subdistrict boundary and acreage outside the subdistrict is developed with a structure or use ancillary to the use exercised within the boundary, the County may, at the sole discretion of the Director of Public Works or his designee, include the additional acreage in the subdistrict and shall calculate the recoupment fee accordingly.
H. 
In no event shall the County collect or reimburse to the developer pursuant to this act recoupment fees which exceed $16,171 per acre for any individual business- or industrial-zoned acre of land served by or through the sewer facilities, i.e. the developer shall not recover more than one non-residential connection fee for the same acre of land.
I. 
The Department of Public Works shall determine the acreage to be used in calculating any non-residential recoupment fees for a split-zoned parcel or lot or for a parcel or lot which is split by the subdistrict boundary.
J. 
The recoupment fees authorized herein shall be charged for all properties subject to such fees which apply for connection and pay connection and/or hook-up charges prior to twenty years following the off-site agreement date.
K. 
Recoupment fees collected pursuant to this article shall be remitted to the developer of the Gunpowder Subdivision or to his authorized assignee in 22accordance with the terms of the Joppa Area Off-Site Utility Recoupment Agreement to be executed by the developer and the County which incorporates the provisions of this act.
L. 
Properties other than those listed herein as part of the subdistrict and those listed as optional properties may obtain service from the subdistrict only with the express approval of the County and only after payment of a recoupment fee calculated in accordance with the terms of § 256-120.
