Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this Part for any person to park a vehicle or allow it to remain parked otherwise.

1. 
Reserved Parking Spaces for the Disabled.
A. 
The Mayor and Borough Council of the Borough of Phoenixville, at its discretion, may provide, at convenient and suitable locations, regulated and nonregulated street parking and reserved spaces for the disabled, and shall designate those spaces by appropriate signs. Except for persons parking vehicles lawfully bearing a person with a disability or a disabled veteran's registration plate or parking placard, no person shall park a vehicle in any such parking space reserved for a person with a disability or a disabled veteran. Likewise, it shall be unlawful for any unauthorized person to utilize a person with a disability or disabled veteran's registration plate or parking placard.
B. 
Additionally, the Borough shall comply with the Americans With Disabilities Act[2] in regards to the number, size and location of disability parking spaces created on Borough-owned property and public streets.

2. 
Creation of On-Street Disabled Reserved Parking.
A. 
The Borough may establish a disability parking space on any public street having regulated parking. The location of such space shall be approved by the Chief of Police and Borough Manager. Anyone legally utilizing a disability parking space where parking is regulated shall be granted an additional 60 minutes of time beyond the posted time limit before a violation is deemed to have occurred.
B. 
The Borough may also establish a disability parking space on any public street having nonregulated parking should a qualified individual submit a formal application to the Borough and satisfy the criteria set forth in Subsection 3 below. The designated representative of the Chief of Police shall review all applications for an on-street disability parking space and shall make a recommendation to the Chief of Police and the Borough Manager, who shall approve or reject all such applications. Upon approval, the Chief or his designated representative shall permit the creation of an on-street disability parking space, and the Borough Manager shall notify the Public Works Director to install the appropriate signage.
C. 
The Chief of Police or his designated representative shall review all disability parking spaces on any public street having nonregulated parking annually, to determine whether or not the individual so requesting the renewal of a disability parking space continues to be eligible under the criteria hereinafter set forth.
3. 
Criteria for Disability Parking Spaces.
A. 
An individual applying for a disability parking space shall exhibit proof that he/she has been issued a disabled person's registration plate or a disabled veteran's registration plate under the regulations issued by the Pennsylvania Department of Transportation for the vehicle indicated on the application.
B. 
No more than one disability parking space shall be issued to any one individual within the corporate limits of the Borough of Phoenixville.
C. 
No more than one disability parking space shall be provided per individual dwelling unit within the corporate limits of the Borough of Phoenixville.
D. 
No disability parking space shall be provided for the location so requested if there exists a reasonably accessible and practicable off-street parking space to serve such location on the property of the location. The term "reasonably accessible and practicable" shall consider the terrain of the property, including buildings, and the necessary accommodation of the disabled person. "Off-street" does not include parking in an alley where all or a portion of a vehicle must rest in the alley right-of-way or which unreasonably blocks access to a driveway or garage on the opposite side of the alley.
E. 
The individual applying for the disability parking space shall first demonstrate to the designated representative of the Chief of Police that either the individual making the application or the person for whom the applicant is the primary mode of transportation has a physical impairment to the extent that a disability parking space is warranted. Such impairments may include, but not be limited to, the loss of use of a lower extremity or a cardiopulmonary condition which substantially restricts the movement of the individual or otherwise requires the use of a wheelchair, crutches, walker or similar device for purposes of locomotion. The designated representative of the Chief of Police shall visit the residence of the applicant, or the person for whom the applicant is the primary mode of transportation, in order to inspect the property and vehicle and interview the applicant, or the person for whom the applicant is the primary mode of transportation.
F. 
No disability parking space shall be created unless it can be demonstrated that the physical condition giving rise to the request is reasonably expected to persist for a period of not less than six consecutive months.
G. 
All applicants who have a disability parking space approved by the procedures set forth in this section are required to reapply for renewal of the space once every year on or before the date of original approval for the disability parking space. Such reapplication shall be made to the Chief of Police or his designated representative in order to demonstrate continued need for the disability parking space. The renewal application shall be free of cost. For any person having an approved space who has not made a renewal application as required, every reasonable effort shall be made to contact that person. Should contact not be successful after a reasonable amount of time, the Chief of Police may direct the disability space be removed.
H. 
Any individual who has an approved disability parking space must report any change in his/her disability status or place of residence within 30 days.
I. 
In considering an application for a disability parking space, a report or letter from the applicant's treating physician may be considered, but such report shall not by itself be considered conclusive of the need for a disability parking space.
J. 
In the event there is a material improvement in the physical condition of the applicant to the extent that the applicant would no longer qualify under the criteria set forth herein, the disability parking space shall be removed. Likewise, the disability parking space shall be removed if there is a change in circumstances such that the disability parking space shall no longer be appropriate under the criteria referred to herein.
K. 
The Chief of Police may, at any time without notice, have a disability parking sign removed when the privilege is being abused. Any complaint of such abuse will first be investigated by the Chief of Police, or his designated representative, who will make a decision in this regard.
L. 
The creation of the disability parking space is not a reserved parking space for the applicant but may be utilized by any vehicle with the proper disability parking placard or registration plate. In the event that an individual other than the person for whom the space was approved begins to utilize the space on a consistent or regular basis simply because that individual does not want to follow the procedures to secure his or her own disability parking space, the following action is authorized: A certified letter shall be sent to the registered owner of the vehicle advising him or her to cease utilizing the space and warning that continued use of the space will constitute an illegal use subject to penalties listed in Subsection 5 and, additionally, recommending that such person apply for his or her own disability space. Should the person fail to positively respond to the letter, a violation of the provisions of this Part shall be deemed to have occurred.
4. 
Appeal Procedure. In the event the application is denied, the Borough Manager shall notify the applicant, in writing, of the reason(s) for denial. The applicant shall have the right to appeal the denial to the Policy Committee of Borough Council within 60 days of the date of notification of the denial. The appeal procedure shall be governed by the Local Agency Law.[3]

5. 
Penalties. Any person violating the provisions of this section is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of not less than $50, nor more than $250, together with all costs of prosecution.

1. 
Findings and Purpose. The Borough of Phoenixville finds that:
A. 
Certain residential areas in the Borough of Phoenixville are subjected to commuter vehicle parking, therefore depriving the residents of those areas of spaces in which to park their own vehicles.
B. 
Those residential streets are also subjected to a high degree of commuter traffic which substantially reduces the quality of the ambient air level.
C. 
The establishment of a parking permit program for certain affected areas should facilitate efficient movement of traffic by providing for parking preference during certain hours of the day and days of the week. Therefore, the Borough of Phoenixville considers it to be in the interest of the people of the Borough to provide for the establishment of a residential permit-parking program to insure primary access to available parking spaces by neighborhood residents and also to provide a cleaner ambient air level.
2. 
Definitions. For the purpose of this section, words and terms listed in this subsection, as follows, shall have the following meanings:
COMMUTER VEHICLE
A motor vehicle parked in a residential area by a person not a resident of that residential area.
CONTRACTOR
A person or entity who does not reside within the designated residential parking permit area, but is performing work on behalf of a property owner on a structure, dwelling or the exterior property of such structure or dwelling, which is adjacent to a street or other location within a residential parking permit area that does not have available off-street parking.
DWELLING UNIT
A single unit providing complete, independent living facilities for one or more persons, including permanent provisions for living, which normally include provisions for sleeping, eating, cooking, and sanitation.

ELIGIBLE EMPLOYEE
A person who does not reside within a designated residential permit parking area, but is an employer or employed by a proprietor, as defined herein, located in the residential permit parking area. For the purpose of this section, an eligible employee shall be required to provide proof of employment at the time of making application for a parking permit and shall only be eligible for one parking permit during their period of employment; no more than two parking permits at any time per business.

OWNER-OCCUPIED
A dwelling in which the owner of record occupies a dwelling unit as his primary residence and resides therein for a minimum of 181 days per annum.

PROPRIETOR
A person who owns or leases real estate within a residential area of which he is not a resident, but who owns or manages a business enterprise or professional office maintained at that address. For the purpose of this section, a proprietor shall be entitled to one parking permit for that business or professional office address.[1]
RESIDENTIAL AREA
A contiguous area containing public highways or parts of public highways primarily abutted by residential property or residential and nonbusiness property (such as schools, parks, places of worship, hospitals and nursing homes).
VISITOR
A person who does not reside within a designated residential permit parking area, but is visiting or residing with a resident on a temporary basis.

3. 
Designation. The Borough Council shall, in consultation with the Borough Manager and staff, designate the residential permit parking areas set forth in Subsection 4 of this section.

B. 
Parking in a designated residential permit parking area shall be in accordance with the following:

(1) 
Vehicles with a residential parking permit may park at any time in the residential permit parking area.
(2) 
Vehicles with a visitor parking permit may park at any time in the residential permit parking area for the period designated on the permit.
(3) 
Vehicles with an employee parking permit may park at any time in the residential permit parking area for the period designated on the permit, but only between the hours of 9:00 a.m. and 5:00 p.m., prevailing time, on the days designated in this section.

C. 
Contractors holding a valid contractor parking permit shall only be permitted to park in the residential permit parking area between the hours of 9:00 a.m. prevailing time and 5:00 p.m. prevailing time.
D. 
Signs shall be erected along the streets in each residential permit parking area, indicating the days, hours, locations and conditions under which parking shall be by permit only.
5. 
Application for Permit. The person desiring a permit shall submit an application to the Borough Manager or his/her designee. This person must be an owner of or authorized by the owner of a motor vehicle as the driver and must reside in or be a proprietor of property immediately adjacent to a street or other location within a residential parking permit area, or be an eligible employee. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a permit fee, in an amount as established in the Master Fee Schedule of the Borough of Phoenixville, to be applied to the cost of administering the residential permit parking program. Each application must contain the following information: the name of the owner or the driver, as the case may be, of the motor vehicle; the address of the resident, the proprietor or eligible employee, as the case may be; the make, model and registration number of the motor vehicle; and the driver number as taken from the applicant’s current driver’s license. Eligible employees shall also provide proof of employment within the designated residential permit parking area at the time of application. At the discretion of the Borough Manager or his/her designee, the applicant shall be required, at the time of making application, to present his/her driver’s license and the vehicle registration card.
6. 
Issuance of Permit.

A. 
Upon receipt of the application and the permit fee, and determination by him that the information upon the application shows that the applicant is entitled to a residential parking permit, the Borough Manager or his/her designee shall issue to the applicant a residential parking permit, which shall be valid for the remainder of the calendar year.
(1) 
No more than three residential parking permits shall be issued for any eligible owner-occupied dwelling unit.
(2) 
No more than two residential parking permits shall be issued for any eligible non-owner-occupied dwelling unit.
(3) 
No more than one residential parking permit shall be issued to a proprietor or eligible employee of any business, professional office or nonresidential property address, with the maximum number of permits limited to two per business.
B. 
The permit shall display the unique permit number assigned and/or be filed electronically in the Borough's parking permit system.

C. 
The permit shall be renewable annually before the expiration date, upon making application for renewal and payment of the permit fee.
D. 
It shall be unlawful and a violation of this section for any person to display other than the current and valid permit while standing or parking in a residential permit parking area at any time when those permits are to be displayed.
7. 
Temporary and Exemption Parking Permits. Temporary parking permits may be issued by the Borough Manager or his/her designee, upon payment of a fee in an amount as established in the Master Fee Schedule of the Borough Council, to contractors and bona fide visitors of residents of a designated residential permit parking area as follows:
A. 
Temporary Permit Applications.
(1) 
Application for a contractor parking permit shall be made to the Borough Manager or his/her designee by the person residing on or who is a proprietor of property immediately adjacent to a street or other location within a residential parking permit area. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a permit fee, in an amount as established in the Master Fee Schedule of the Borough of Phoenixville, to be applied to the cost of administering the residential permit parking program. Each application shall contain the following information: the name of the owner or the driver, as the case may be, of the motor vehicle; the address of the resident or proprietor, as the case may be; the make, model and registration number of the motor vehicle; and the driver number as taken from the contractor’s current driver’s license. At the discretion of the Borough Manager or his/her designee, the contractor shall be required, at the time of making application, to present a vehicle registration card.
(2) 
Application for a visitor parking permit shall be made to the Borough Manager or his/her designee by a person residing on a property immediately adjacent to a street or other location within a residential parking permit area. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a permit fee, in an amount as established in the Master Fee Schedule of the Borough of Phoenixville, to be applied to the cost of administering the residential permit parking program. Each application shall contain the following information: the name of the owner or the driver, as the case may be, of the motor vehicle; the address of the resident; the make, model and registration number of the motor vehicle; and the driver number as taken from the visitor’s current driver’s license. At the discretion of the Borough Manager or his/her designee, the visitor shall be required, at the time of making application, to present a vehicle registration card.
B. 
Temporary Permit Issuance.
(1) 
Upon receipt of a contractor application and the permit fee, and determination by the Borough that the information upon the application shows that the applicant is entitled to a contractor parking permit, the Borough Manager or his/her designee shall issue to the applicant a contractor parking permit, which shall be valid for up to 30 days. No more than two contractor parking permits shall be issued for any eligible property which is adjacent to a street or other location within a residential parking permit area. The permit shall display the residential parking area number and the expiration date. The permit shall be renewable on or before the expiration date, upon making application for renewal and payment of the permit fee. It shall be unlawful and a violation of this section for any contractor to display other than a current and valid permit while standing or parking in a residential permit parking area at any time when those permits are to be displayed.

(2) 
Upon receipt of a visitor application and the permit fee, and determination by the Borough that the information upon the application shows that the applicant is entitled to a visitor parking permit, the Borough Manager or his/her designee shall issue to the applicant a visitor parking permit, which shall be valid for up to 14 days. No more than two visitor parking permits shall be issued for any eligible residence which is adjacent to a street or other location within a residential parking permit area. The permit shall display the license plate numbers of the motor vehicle, the residential parking area number and the expiration date. The permit shall be renewable once on or before the expiration date, upon making application for renewal and payment of the permit fee. It shall be unlawful and a violation of this section for any visitor to display other than a current and valid permit while standing or parking in a residential permit parking area at any time when those permits are to be displayed.
C. 
Exemption. Parking permits may be issued to residents or eligible employees with a physical disability without payment of a fee.
8. 
Responsibility of Permit Holder.
A. 
Notwithstanding any provision of this section to the contrary, the holder of a residential parking permit shall be permitted to stand or park a motor vehicle operated by him in any designated residential parking area during those times when parking of motor vehicles is permitted in that area. While a vehicle for which a residential parking permit has been issued is so parked, that permit shall be displayed so as to be clearly visible through the windshield of the vehicle. A residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential permit parking area.
B. 
A residential parking permit shall not authorize its holder to stand or park a motor vehicle in any place where or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles, nor shall the permit exempt its holder from the observance of any traffic or parking regulation other than residential permit parking regulation or restriction.
C. 
No person other than the permit holder whose name appears on the permit shall use a residential parking permit or display it on a vehicle operated; any such use or display by a person other than the permit holder shall constitute a violation of this section by the permit holder and by the person who so used or displayed the parking permit.
D. 
It shall constitute a violation of this section for any person falsely to represent himself as eligible for a residential parking permit or to furnish false information in an application to the Borough Manager or his/her designee in order to obtain a residential parking permit.

9. 
Revocation of Permits. The Borough Manager or his/her designee shall have authority to revoke the residential parking permit of any permit holder found to be in violation of any provision of this section. Upon written notification to the permit holder of the revocation, the permit holder shall surrender the permit to the Borough Manager or his/her designee. Failure to do so, when so requested, shall constitute a violation of this section, provided that any person receiving such a notice may, within 10 days after the date of the notice, appeal to the Borough of Phoenixville for a hearing on the revocation, and the decision of the Borough of Phoenixville shall be final.

The Borough Manager, or his/her designee, shall have the authority to issue temporary permits to any person, firm, or corporation, upon written application by such person, firm, or corporation, upon deposit of the parking lot rental fee in an amount as established in the Master Fee Schedule of the Borough of Phoenixville. Permits shall allow the use of the lots for a period not to exceed 24 hours.

The Borough may install bicycle racks in the lots as designated below, and where such racks are installed, bicycles may be parked at such racks without the payment of parking fees. For the purpose of this section, a "bicycle" is a vehicle with two wheels, one behind the other, intended to be powered principally by human power. The meaning of the word "bicycle" also includes a three-wheeled vehicle, intended to be powered principally by human power.

1. 
Parked vehicles to be wholly within individual parking spaces. When lines and/or markings are painted or placed upon Borough parking lots to establish parking spaces, each vehicle parking in such lot shall be parked wholly within the lines or markings identifying a space. It shall be unlawful and a violation of this section for any person to park any vehicle:
A. 
Across any such line or marking;
B. 
In a position that is not wholly within the area so designated by such lines or markings as the parking space (e.g., vehicles shall not protrude into traffic aisles; or
C. 
Anywhere other than a designated parking space (e.g., such prohibited parking areas include, but are not limited to, traffic aisles.
2. 
Orientation of Parked Vehicles. It shall be unlawful to park any vehicle in any Borough owned parking lot other than with the front of the vehicle parked nearest to the tire barrier and/or furthest from the traffic aisle.
3. 
Through Traffic Prohibited. No person shall operate a motor vehicle through the traffic lanes or aisles within a Borough-owned parking lot for any purpose other than parking within the lot, and the lanes reserved for parking lot traffic shall not be used as a general thoroughfare by the traveling public.
4. 
Parking Prohibited For Snow Removal. It shall be unlawful to park any vehicle in any Borough-owned parking lot when snow removal operations have begun at the lot and/or when the Borough posts no-parking notice at the lot. It shall also be unlawful to allow any vehicle to remain parked in any of the Borough-owned parking lots between the hours of 12:00 midnight and 6:30 a.m., when the Borough has given at least three hours notice of its intention to remove snow from the lot or when two or more inches of snow have accumulated in the lot and significant accumulation has ceased for at least two hours.

EMPLOYEE
A person who is employed by a proprietor as defined herein. For the purpose of this section, an employee shall be required to provide proof of employment at the time of making application for a parking permit and shall only be eligible for one parking permit during his/her period of employment.
PROPRIETOR
A person who owns or leases real estate within the Borough of Phoenixville and who owns or manages a business enterprise or professional office maintained at that address. For the purpose of this section, a proprietor shall be entitled to one parking permit.
RESIDENT
A person who owns or leases real property within the Borough of Phoenixville and who maintains either a voting residence or bona fide occupancy, or both, at that address. For the purpose of this section, a resident shall be entitled to two parking permits per residential unit.
2. 
Application for Issuance of Parking Lot Permits for Parking Lots Leased to or Owned by the Borough of Phoenixville. The Borough Manager or his designee shall accept applications for the issuance of parking lot permits for parking lots leased to or owned by the Borough of Phoenixville and for which a charge is otherwise made for the parking of motor vehicles. The applications for parking lot permits shall be obtained at the Borough of Phoenixville business office. Proprietors, residents and employees as defined in this section, shall be eligible for parking lot permits.
3. 
Issuance of Parking Lot Permits Upon Payment of Fee. The Borough Manager or their designee shall determine if an applicant is eligible for a parking lot sticker. If the Borough Manager or their designee determines that an applicant is eligible for a parking lot sticker, the same shall be issued to any such eligible applicant for use with only the vehicle identified on the application by vehicle make, model and license plate number, upon payment to the Borough of Phoenixville in an amount as established in the Master Fee Schedule of the Borough of Phoenixville. Permits are issued on a first-come-first-serve basis. There are no guaranteed parking spots.

4. 
Validity of Parking Lot Permits.

A. 
The parking lot permits provided herein shall be valid for one to 12 months in a calendar year and the entire parking lot sticker fee provided in an amount as established in the Master Fee Schedule of the Borough of Phoenixville shall be payable upon issuance of the parking lot sticker, irrespective of the date of the month of the issuance of the sticker. The recipient of a parking lot sticker issued as provided herein shall prominently display the sticker on the recipient's motor vehicle whereupon the recipient shall have the privilege of parking, without paying any additional parking fee, in any Borough of Phoenixville parking lot so designated for such parking and for which a charge for parking is otherwise made.
5. 
Making of Facsimiles. It shall be a violation to create and intentionally display on any motor vehicle a facsimile of a parking lot sticker issued as provided herein or any other device for the purposes of obtaining the privileges accruing to those persons who obtain a parking lot sticker as provided herein.
6.

It shall be unlawful to park any vehicle or to allow any vehicle to remain parked in any of the parking lots established herein at any time between the hours of 12:00 midnight and 6:30 a.m. when the Borough shall have given at least three hours notice of its intention to remove snow from the surface of the parking lots.

In addition to the parking regulations set forth in this Chapter, the following are specifically prohibited:
A. 
Parking on private property without permission of owner, lessee or authorized agent;
B. 
Parking within 15 feet of a fire hydrant;
C. 
Parking within 30 feet of the approach to a flashing signal, stop sign, yield sign or traffic-control signal located at the site of a roadway;
D. 
Parking within 20 feet of a crosswalk or intersection;
E. 
Parking in front of a public or private drive;
F. 
Parking on roadway side of any vehicle stopped or parked at the edge or curb of a street;
G. 
Parking in a fire zone;
H. 
Parking within 20 feet of the driveway entrance to any fire station or, when properly sign-posted, on the side of a street opposite the entrance of any fire station within 75 feet of the entrance;
I. 
Parking vehicle against traffic flow;
J. 
Parking too far from curb;
K. 
Parking on a sidewalk;
L. 
Parking in any place where official signs prohibit standing; and
M. 
Parking in any place where official signs prohibit or restrict parking.

1. 
Purpose. The electric vehicle parking standards established in this Part are intended to promote sustainable and alternative transportation practices; manage the availability of off-street parking, particularly in areas that will maximize the use of electric vehicles; and thereby improve traffic and parking circulation.
2. 
Definitions. As used in this chapter, unless otherwise apparent from the context, the following words and phrases shall have the following meanings:
ELECTRIC VEHICLE
A vehicle that operates, either partially or exclusively, on electrical energy from the electrical grid, or an off-grid source, that is stored on board for motive purposes.
ELECTRIC VEHICLE CHARGING STATION
Equipment that has as its primary purpose the transfer of electric energy to a battery or other energy storage device on an electric vehicle.
3. 
Designation of Electric Vehicle Parking Spaces.
A. 
The Borough Manager, or their designee, is authorized in accordance with the purposes of this chapter to designate spaces in off-street public parking facilities as identified in § 15-701 for the exclusive parking of electric vehicles that are connected to electric vehicle charging stations for the purpose of transfer of electricity to the battery or other energy storage device of an electric vehicle.
B. 
Signs or markings. Upon designation of a parking space or spaces for the exclusive use of electric vehicles pursuant to Subsection 3A, the parking department shall place signs or markings giving adequate notice that the parking space or spaces are restricted and to be used only for such electric vehicles. The signs or markings shall indicate that vehicles left standing in violation of the restriction may be removed. The parking restriction shall not apply to the designated parking spaces until the sign or markings have been placed.
4. 
Public Parking Spaces for Charging of Electrical Vehicles. The Borough may designate parking spaces for use as electric charging stations within lots identified in § 15-701. Use of said charging station spaces shall be limited and restricted as follows:
A. 
It shall be unlawful for any person to park or leave a vehicle standing in a designated stall or space unless the vehicle is an electric vehicle and is connected for electric charging purposes.
B. 
Nonelectric vehicles are prohibited from parking in the charging station spaces in lots per § 15-701.
C. 
Electric vehicles are authorized to park in the spaces designated within lots per § 15-701 as charging spaces only during the time the vehicle is connected for electric charging purposes. When the vehicle is no longer charging, the owner or operator of said vehicle shall be required to remove the vehicle from the charging station space.
D. 
No electric vehicle shall be connected to an electric charging station in any lot per § 15-701 for more than four hours from 7:00 a.m. to 10:00 p.m.
5. 
Designation of Electric Vehicle Permit Parking Areas. The Borough Manager, or their designee, is authorized in accordance with the purposes of this chapter to designate spaces in off-street public parking facilities as identified in § 15-701 as designated electric vehicle permit parking areas.

A. 
Vehicles with an electric vehicle parking permit may park at any time in the electric vehicle permit parking area.
B. 
Electric vehicle parking permits shall be issued in accordance with the provisions of § 15-417, Subsections 1 through 5.

6. 
Exemptions. The following are exempted from the provisions above:

This section shall not apply to emergency vehicles and apparatus or municipal vehicles.
7. 
Electric Vehicle Parking Enforcement. The parking enforcement officer or police department is authorized to cite and/or remove or cause the removal of vehicles parked in violation of this section.
8. 
Fees.

A. 
Electric Vehicle Charging. The rates charged by the Borough of Phoenixville for charging stations within lots identified in § 15-701 to the public shall be those as set in accordance with the Borough of Phoenixville Master Schedule of Fees.
B. 
Electric Vehicle Permit. The rates charged by the Borough of Phoenixville for electric vehicle permits within lots identified in § 15-701 shall be those as set in accordance with the Borough of Phoenixville Master Schedule of Fees.

It shall be the duty of the police officers and parking enforcement officers of the Borough of Phoenixville to enforce all violations of any provision of this Part indicating, in each issued ticket or notice of violation:
A. 
The Section violated;
B. 
The license number of the vehicle involved in the violation;
C. 
The location where the violation took place; and
D. 
If necessary, any other facts that might be necessary in order to secure a clear understanding of the circumstances attending such violation.

Any person violating any provision of this Part shall, for each and every such violation and upon conviction thereof, be sentenced to pay a fine in an amount as established in the Master Fee Schedule of the Borough of Phoenixville, plus costs, except for a violation of § 15-419, Subsection G, parking in a fire zone, for which the fine will be in an amount as established in the Master Fee Schedule of the Borough of Phoenixville, plus costs, and a violation of § 15-419, Subsection M, parking in any place where official signs prohibit or restrict parking, for which the fine will be that posted on the official sign or, in default of payment of said fines and costs, to undergo imprisonment for not more than five days.
