This article shall be known by the short title of "Alley Improvement
Ordinance of 1964."
As used in this article, the following terms shall have the
meaning indicated:
ALLEY
Unless otherwise stated in this article, the term "alley"
shall designate public street or thoroughfare in the Borough of Muncy
which does not qualify for state or county improvement funds.

The President of Council and the Borough Secretary-Treasurer
are hereby authorized to enter into a contract or contracts in the
name of the Borough, for the whole or any part of said work, or for
materials or labor connected therewith, with such party or parties
and upon such terms as the Council may determine or agree upon; or
if the Borough Council by motion so desires, the work or any part
thereof shall be done under the supervision of the Street Committee
and the Street Commissioner.

Whatever curbing and/or guttering shall be necessary, in the
opinion of the Working Supervisor of Public Works, to make a complete
job, shall likewise be constructed, and the entire costs thereof shall
be assessed against the abutting properties according to foot-front
rule.

Any assessment authorized under this article shall be paid either
in full, within 30 days after notice of such assessment shall have
been given to the party assessed, as provided in the Borough Code,
or in four equal semiannual installments, the first of which shall
be due and payable within 30 days after such notice. All assessments,
whether paid in full or in installments, shall be payable to the Borough
Secretary-Treasurer.

If any assessment authorized under this article shall not have
been paid in full, or if an installment payment of 1/4 the total amount
of such assessment shall not have been made within 30 days after notice
of such assessment shall have been given to the party assessed, the
entire assessment shall be due, and it shall be the duty of the Borough
Solicitor to collect the same, with interest, from the time of completion
of improvement, by action of assumpsit, or by a lien to be filed and
collected in the same manner as municipal claims.

In case anyone against whom assessment shall have been made under this article shall have paid an installment of 1/4 the total amount thereof within 30 days after notice of such assessment, such party shall pay the remaining 3/4 of such assessment in three subsequent semiannual installments, the first of which shall be due within six months after first installment became due, and the remaining installments shall become due at six month intervals thereafter. All such installments shall bear interest at a rate of 10% commencing 30 days after the notice of the total assessment referred to in §
236-37 of this article. The payment of such assessment shall be governed strictly by §§ 1775 to 1781, inclusive, of the Borough Code, as amended.
