The Newark Cemetery was acquired from Newark Cemetery Association (also known as "Newark Centre Cemetery Association") after an advisory referendum of the electors of the Town held on September 8, 1970, upon a vote of 93 in favor and 75 against, and pursuant to resolution of the Town Board adopted May 16, 1972, and the legal description of such cemetery is as follows:
That part of the Southeast Quarter of the Southwest Quarter (SE 1/4 SW 1/4) of Section Thirty-five (35), Township Twelve (12) North, Range Nineteen (19) East, described as follows:
Commencing at the South quarter corner of said Section 35, thence north along the quarter line 3.88 chains to the place of beginning of this description; thence North 66° 30' West 5.466 chains, more or less, to the most westerly corner of land described in Volume 9 of Deeds on page 205, thence continuing North 66° 30' West 14 feet, more or less, to the west line of cemetery land now owned by grantors, thence North 33° 30' East 322 feet, thence South 66° 30' East to a point on the east line of the SE1/4 of the SW1/4 of said Section 35, thence south along said east line to the place of beginning.

The Town Board shall constitute the Cemetery Board, and the Town Clerk shall, ex officio, be Secretary-Treasurer of the Cemetery Board.
The plat of such cemetery heretofore adopted and recorded shall continue in effect and be expanded under the provisions of § 157.07, Wis. Stats., to cover all of the undeveloped land in said cemetery.
The perpetual care fund obtained from the Newark Cemetery Association, together with all additional perpetual care funds, shall be invested as provided in Chapter 881, Wis. Stats., under the direction of the Cemetery Board.

A. 
Fees for cemetery burial sites shall be established by the Town Board and included in the Town Fee Schedule.
B. 
One-half of the cost of a lot or site is to be invested in a perpetual care fund. The income from the care fund is to be used only to maintain the cemetery lots and grounds.

Owners of grave sites shall have the right to transfer or convey such rights to members of their family, but such transfer and conveyance shall not be effective until filed with the Cemetery Board.
No trees or spreading shrubs shall be permitted on any platted lot, and all gravestones or monuments must be erected on concrete slabs six inches thick, flush with ground level, and which shall extend six inches beyond all sides of the stone or monument.
Application for permission to open a grave shall be made to the Town Clerk, and such opening shall be in the manner prescribed by the Cemetery Board in order to protect the adjacent lots.
The excavation shall only be made by qualified persons who are approved by the Cemetery Board, and the fee for each grave shall be fixed by the Cemetery Board.
The net income from the perpetual care fund shall be used to provide for regular care of the cemetery.

The Town Meeting may authorize the Town Board to appropriate up to $500 in any year for the improvement of the Town cemetery, under supervision of the Town Board.

All conveyances of platted lots or grave sites shall be in accordance with § 157.08, Wis. Stats., and the same shall be signed by the Chair and Secretary of the Cemetery Board.
The Cemetery Board shall employ a part-time sexton who shall be responsible for the supervision and care of the cemetery, and his hours of employment and compensation shall be fixed annually by the Cemetery Board.
