The Town of Barton is increasing in population due to urban development within the Town, and the public health, safety, welfare and convenience require that limitations and restrictions be made upon the transporting in and through the Town of dangerous and inflammable materials and the dumping or disposal in the Town of inflammable materials, garbage and rubbish.
It shall be unlawful for any person or municipality to:
A. 
Transport in or through the Town of Barton any materials for the purpose of dumping or disposing of the same within said Town which contain or consist of inflammable oils, gases, greases and similar material, unless the same shall be transported in a vehicle that has a closed or sealed metal body or tank.
B. 
Deposit or bury rubbish or garbage consisting of or containing any inflammable liquids, oils or greases within the Town of Barton, in an established dump or elsewhere, in such quantities as the Town Board shall determine will tend to contaminate the underground or surface water resources of the Town of Barton.
C. 
Transport any garbage, rubbish or other refuse into or within the Town of Barton over any highways or roadways which pass private property not owned by the person or municipality transporting the same for the purpose of dumping or otherwise disposing of the same until such person or municipality shall first have secured a permit so to do from the Town Board.
D. 
Deposit any materials consisting of or containing any inflammable liquids, oils or greases within the Town of Barton, in an established dump or elsewhere, unless the same shall be disposed of by incineration in an enclosed incinerator of such size and design as not to eject, discharge or emit into the open air any offensive smoke, fumes, gases, acids, burning embers, sparks or cinders.
E. 
Deposit on lands owned, leased or controlled by such person or municipality any materials which, by the action of wind or otherwise, shall fall or be deposited upon any adjacent property not owned, leased or under the control of such person or municipality.
Any person or municipality who shall violate any provision of this article shall be fined not more than $50 for the first offense and fined not more than $100 upon conviction of the same offense a second or subsequent time within each year.
