A. It shall be unlawful for any person to set or start a bonfire or
other fire out of doors within the boundaries of the Town of Barton
without a burning permit except for any State of Wisconsin-licensed
campground currently recognized by the Department of Health Services.
The Chair or any of the Supervisors of the Town of Barton may issue
a burning permit to a property owner in the Town of Barton to burn
brush, leaves, needles, grass, clean wood and unrecycled paper and
cardboard. The Chair or a Supervisor is to instruct the person obtaining
the burning permit that the fire needs to be adequately supervised
and will not spread out of control or endanger life or property. The
property owner is to call the Washington County Sheriff's Department's
nonemergency number to report that he will be burning and has obtained
the required permit.
Burning barrels with screen coverings are allowed for burning
without a burning permit. Any out-of-control fires that result will
be charged back to the property owner(s). The Town of Barton allows
the following to be burned with or without a permit in a burn barrel:
brush, leaves, needles from pine trees, grass clippings, clean wood
and unrecyclable paper and cardboard.
The Town Chair shall be ex officio Fire Warden of the Town of
Barton. The Chair and all Town Supervisors can issue burning permits.
Any person who violates any provision of this chapter shall
be liable to the Town of Barton for all costs and expenses incurred
in fighting or extinguishing such fire. In addition, the property
owner shall forfeit $100 if a burning permit was not obtained. Failure
to pay the amount invoiced shall be assessed to the property owner's
tax bill.
The Town Board, in the adoption of this chapter, shall be deemed
to have exercised the powers of a Village Board pursuant to the authority
granted to it by the electors of the Town.
