It shall be unlawful for any person to permit any premises owned,
occupied, or controlled by him to become or remain in a filthy condition
or to permit the use or occupation of the same in such a manner as
to create noxious or offensive smells and odors in connection therewith
or to allow the accumulation or creation of unwholesome and/or offensive
matter or the breeding of flies, rodents, or other vermin on the premises
to the menace of the public health or the annoyance of people residing
within the vicinity.
Except as permitted by Chapter
329, Article
II, of this Code, it shall be unlawful for any person to sweep into or deposit in any gutter, street, or other public place within the Town any accumulation of ice or snow which has formed on any private or public lot or private or public sidewalk or driveway.

Any person who violates any of the provisions of this article
shall be guilty of an infraction and, upon conviction thereof, shall
be punished by a fine of $50 for a first offense. For a second offense
within a calendar year, a person shall be subject to a fine of $100.
For a third or subsequent offense within a calendar year, a person
shall be subject to a fine of $250. Each day during which the violation
of any provision of this article shall continue shall constitute a
separate offense.
