Members of the Department shall not accept any police-related outside employment during off-duty hours without the prior written approval of the Chief of Police. The Chief of Police shall have the sole discretion to approve the police-related outside employment of any member of the Department.
A. 
Any company, organization or contractor that desires to hire off-duty members of the River Vale Police Department shall submit the request in writing to the Chief of Police on a form prescribed by the Chief of Police.
B. 
Each such requesting person shall furnish a "certificate of insurance" as soon as practicable and not less than five business days before the date of the planned activity to the Township, naming the Township and the Police Department as additional insureds. Said insurance shall be written with a company maintaining a rating of at least "A-," according to A.M. Best. Said policy shall be in an amount of not less than $1,000,000 per occurrence. In the event said certificate of insurance is not provided as set forth above, the request for an officer shall not be granted.
C. 
Any requesting person shall be obligated to reimburse the Township of River Vale for all reasonable attorneys' fees incurred to defend itself against any claim, suit, demand for subrogation, or other action which arises from the hiring of an off-duty member.
A. 
The company, organization or contractor that hires an off-duty member of the Police Department shall pay a fee to the Township as follows:
(1) 
An officer hired for non-traffic-control or security details shall be compensated at $60 per hour plus a 10% administrative fee inclusive of F.I.C.A. contributions.
(2) 
The rate of $60 per hour established in 2012 shall increase annually at the rate of 2.5%.
B. 
Officers assigned to a non-traffic-control or security detail shall receive a minimum compensation of four hours. Details exceeding the originally scheduled hours shall be compensated at a minimum of two-hour increments until the completion of the detail.
C. 
All cancellations require a minimum two hours' notification prior to the scheduled start time of the detail. Noncompliance of this cancellation notice shall result in the officer receiving a minimum of four hours' compensation.
D. 
Upon the submission of a request to hire off-duty members of the Police Department, said company, organization or contractor shall submit funds in the estimated amount of the compensation to be paid to the off-duty police officers. The funds received by the Township shall be deposited in an escrow account, and such funds shall be utilized to pay the off-duty police officers. The Township shall notify the organization or contractor upon the expenditure of 50% of the escrow funds. At that time, a determination shall be made as to whether or not the balance is sufficient to pay for further services that may be required. In the event the remaining balance is insufficient, the company, organization or contractor shall, within 24 hours of notice of the deficiency, deposit funds in an amount sufficient to cover the additional services. Any funds remaining in the escrow account shall be refunded to the organization, vendor or contractor that posted said escrow funds within 60 days of receipt by the Township of the refund request.
E. 
Invoices shall be paid in full within 45 days of the date of the invoice. In the event the invoice is not paid in full within 45 days, the organization or contractor shall, for all future hiring of off-duty police officers, pay in advance the amount of the compensation to be paid to the off-duty police officers.
