Wherever the following words or phrases are used they shall, for purposes of this Article 19, have the meanings ascribed to them in this Section
14-19-1, except when the context otherwise indicates.
DONATION COLLECTION BIN
An unattended container, receptacle or similar device that
is (a) placed outdoors, and (b) used for the solicitation and collection
of donations of clothing, shoes, books, small household items, and
other salvageable personal property from the public.

No donation collection bin shall be installed, placed, or operated
in any outdoor location within the Village except (a) upon the issuance
by the Village of an annual license therefor, and (b) in compliance
with this Article 19.

(A) Application.
An applicant for a donation collection bin license shall file an application
therefor with the Village Director of Community Development, on a
form provided by the Village, which application shall include, without
limitation, the following information:
(1) The name, mailing address, telephone number and electronic mail address
of the applicant;
(2) The name, mailing address, and telephone number of the owner of the
property on which the donation collection bin will be installed or
placed, if different;
(3) The street address of the property on which the donation collection
bin will be installed or placed;
(4) A plat of survey of the property on which the donation collection
bin will be installed or placed, which plat of survey shall depict
the approximate location of the proposed donation collection bin;
and
(5) Payment of a nonrefundable donation collection bin license application
fee in the amount set forth in the Annual Fee Resolution.
(B) Approval
or denial of application; revocation.
(1) Approval. Upon receipt of a complete application for a donation collection
bin license, and upon a determination that the application satisfies
the standards and conditions set forth in this Article 19, the Village
Director of Community Development shall approve the application and
issue a donation collection bin license to the applicant. The Village
Director of Community Development may condition approval of the application
upon additional provisions or restrictions that are consistent with
the provisions set forth in this Article 19.
(2) Denial or revocation. The Village Director of Community Development
may revoke a donation collection bin license or deny an application
for a donation collection bin license upon a determination that:
(a) The application contains any false fraudulent or misleading material
statement;
(b) Either the application or the proposed donation collection bin does
not satisfy the standards and conditions set forth in this Article
19;
(c) The applicant has made any false, fraudulent or misleading material
statement in the course of operating a donation collection bin in
the Village;
(d) The applicant has previously violated any statute, ordinance, rule
or regulation relating to the operation of a donation collection bin
in the Village; or
(e) Installation, placement or operation of the proposed donation collection
bin will be injurious to the public health safety or welfare.
(3) Notification of denial or revocation. Upon the revocation of an existing
donation collection bin license or the denial of an application therefor,
the Village Director of Community Development or his or her designee
shall notify the applicant by first class mail.
(4) License term. Each license issued pursuant to this Section
14-19-3 shall terminate on the 31st day of December following its issuance.
