Leaving an animal in one's care, whether as owner or
custodian, for any period of time without effective provision for
its food, water, or other care as is reasonably necessary for the
animal's health.
That the living area for each animal being kept confined
or restrained shall have adequate drainage such that the animal shall
be free to walk or lie down without coming in contact with standing
water or other liquid.
Any live, vertebrate member of the Animal Kingdom.
The Animal Control Authority shall be either persons designated
by the City of Papillion or any organization the City of Papillion
contracts with to provide animal control, and said organization shall
have all of the authority, rights and privileges of law enforcement
as if the organization or its agents, servants and employees were
employees of the City of Papillion.
Any individual employed, appointed, or authorized by an Animal
Control Authority for the purpose of aiding in the enforcement of
this chapter or any other law or ordinance relating to the licensure
of animals, control of animals, or seizure and impoundment of animals
and includes any state or local law enforcement officer or other employee
whose duties, in whole or in part, include assignments that involve
the seizure and impoundment of any animal.
An entity or person(s) who:
Is a member of an organization that provides care or fosters
pet animals that have been lost, abandoned, surrendered or otherwise
disowned;
Trains, alters (spay/neuter), vaccinates, rehabilitates and
otherwise treats rescued pet animals to bring them into adoptable
condition;
Finds suitable adoptive homes for rescued pet animals;
Provides assistance to insure the permanent welfare of the adopted
pet; and
Educates the public regarding the scope of animal rescue activities
and pet animal owners to prevent abandonment.
An animal control authority is not an animal rescue for purposes
of this chapter.
Any facility operated by a humane society or municipal agency
or its authorized agents for the purpose of impounding or caring for
animals held under the authority of this chapter or state law.
Any animal that is not under the direct control of the owner.
Any Felis domesticus animal, male or female, sexed or neutered.
Any pet shop, grooming shop, auction, riding school or stable,
zoological park, circus, performing animal exhibition or kennel.
Any Canis lupus familiaris animal, male or female, sexed
or neutered.
A cat, a dog, or livestock. Livestock includes buffalo, deer,
antelope, fowl, and any other animal in any zoo, wildlife park, refuge,
wildlife area, or nature center intended to be on exhibit.
Any nonhuman primate or animal that is native to a foreign
country or of foreign origin or character, is not native to the United
States, or was introduced from abroad. This term specifically includes
animals such as, but not limited to, lions, tigers, leopards, elephants,
camels, antelope, anteaters, kangaroos, venomous snakes, venomous
insects, venomous reptiles, and water buffalo, and species of foreign
domestic cattle, such as ankole, gayal, and yak. This includes nonvenomous
reptiles that will grow to more than five feet in length at maturity
and nonvenomous snakes that will grow to more than eight feet in length
at maturity.
A commercial establishment where animals are bathed, clipped,
plucked or otherwise groomed.
Any premises wherein any person engages in the business of
boarding, breeding, buying, letting for hire, training for a fee or
selling any animal.
The City of Papillion, Nebraska, or its designee.
Treatment administered by a physician or other licensed health
care professional that results in one or more sutures, surgery, or
treatment for one or more broken bones.
A pure-bred animal of any subspecies of Sus scrofa, including
the Vietnamese potbellied pig.
Intentionally causing permanent injury, disfigurement, degradation
of function, incapacitation, or imperfection to an animal but does
not include acts classified as torture.
A basket or cage-like device approved by the Animal Control
Authority to cover the animal's mouth and snout to prevent the
animal from biting but which allows the animal to open its mouth to
pant and drink.
Unless otherwise specified, shall mean to possess, keep,
harbor or have control of, charge of or custody of a dog or cat. This
term shall not apply to dogs or cats owned by other persons which
are temporarily maintained on the premises of a veterinarian or kennel
operator for a period of no more than 30 days.
Any person possessing, keeping, harboring or having charge
or control of, or permitting any dog or cat to habitually be or remain
on, or be lodged or fed within, such person's house, yard or
premises. An animal shall be deemed to be harbored if it is fed or
sheltered for five consecutive days or more. This term shall not apply
to veterinarians or kennel operators temporarily maintaining on their
premises dogs or cats owned by other persons for a period of not more
than 60 days.
Any domestic dogs, domestic cats, domestic rabbits, domestic
ferrets, domestic rodents, birds except those defined as agricultural
animals and specifically including any birds possessed under a license
issued by the State of Nebraska and/or the United States Fish and
Wildlife Service, nonlethal aquarium fish, nonlethal invertebrates,
amphibians, turtles, nonvenomous lizards that will not grow to more
than five feet in length at maturity, nonvenomous snakes that will
not grow to more than eight feet in length at maturity, or such other
animals as may be specified and allowed by law; provided, however,
that any animal forbidden to be sold, owned, or possessed by federal,
state, or municipal law is not a pet animal.
Any person, partnership or corporation, whether operated
separately or in connection with another business enterprise, except
for a licensed kennel, that buys, sells or boards any species of animal.
Any animal or animals which:
The Animal Control Authority, any police officer or other
officer designated by the Mayor.
The means by which any animal is secured by a leash or lead
or within the real property limits of its owner.
Any bodily injury which involves a substantial risk of death,
or which involves substantial risk of serious permanent disfiguration
or protracted loss or impairment of the function of any bodily organ,
resulting in one or more sutures, surgery, or treatment of the health
impairment.
Any injury or illness to any domestic animal which creates
a substantial risk of death or which causes broken bones, prolonged
impairment of health or prolonged loss or impairment of the function
of any bodily organ, resulting in one or more sutures, surgery, or
treatment of the health impairment.
Any unlicensed animal found roaming at large, frequently
or remaining on private or public property, without the consent of
the owner or tenant of said property.
Intentional subjection of an animal to extreme pain, suffering,
or agony but does not include conduct conforming to accepted veterinary
practice performed by a veterinarian licensed to practice veterinary
medicine and surgery in the State of Nebraska.
Any animal that constitutes a physical threat to human beings
or other animals.
Any animal which is now or historically has been found in
the wild, or in the wild state, within the boundaries of the United
States, its territories, or possessions. This term includes, but is
not limited to, animals such as: any nonhuman primate, deer, skunk,
opossum, raccoon, mink, armadillo, coyote, squirrel, fox, wolf, poisonous
or venomous snake, poisonous or venomous insect, poisonous or venomous
reptile, lynx, and bear. This includes nonvenomous reptiles that will
grow to more than five feet in length at maturity and nonvenomous
snakes that will grow to more than eight feet in length at maturity.
