As used in this article, the following terms shall have the indicated meanings:
ASHES
The residue resulting from the burning of wood, coal or other combustible material.
DISPOSAL
The storage, collection, disposal or handling of refuse.
GARBAGE
All animal and vegetable wastes resulting from the handling, preparation, cooking or consumption of foods.
HEALTH OFFICER
The person appointed by the Township council to serve in that capacity, and his assistants.
PERMIT
A written license issued by the health officer permitting the operation of a trash transfer station.
REFUSE
All solid wastes, except body wastes, and shall include garbage, ashes and rubbish.
RUBBISH
Glass, metal, paper, plant growth, wood or nonputrescible solid wastes.
TRASH TRANSFER STATION
A controlled disposal site where refuse is dumped into a mobile compactor for further transfer to an ultimate site of disposal.

It shall be unlawful for any person to conduct a trash transfer station within the Township, unless he holds a valid permit issued by the health officer.

All applications for permits required by this article shall be made in writing to the health officer.

The health officer shall issue permits required by this article upon compliance by the applicant with the rules and regulations set out in this article and shall include:
(1) 
Name and address of applicant.
(2) 
Location of the property on which the trash transfer station will be located.
(3) 
A plan showing the design and location of buildings and structures and a surface drainage scheme.

The fee for a permit required by this article shall be one thousand two hundred fifty dollars ($1,250.00) per year. There shall be no reduction in the fee for a license issued after the beginning of the year.

(a) 
The health officer may refuse to grant a permit for the operation of a trash transfer station if, after an inspection of the proposed site, in his judgment, it will not meet the requirements of this article.
(b) 
Further information as may be required by the health officer to substantiate that the trash transfer station will comply with regulations promulgated by the health officer shall be supplied by the applicant.

Any person whose application for a permit under this article has been denied by the health officer may request, and shall be granted, a hearing on the matter before the Council of Plymouth Township within thirty (30) days after the date of denial.

If the person holding a permit to operate a trash transfer station fails to prosecute the work to the satisfaction of the health officer, or fails to perform any of the covenants of the rules and regulations set out in this article, the health officer, on twenty-four (24) hours notice in writing, delivered or posted at the site, may annul the permit.

All permits issued under this article shall be issued for the calendar year.

(a) 
The health officer is hereby authorized and directed to make such inspections as are necessary to determine satisfactory compliance with this article, and the regulations promulgated hereunder.
(b) 
It shall be the duty of the owner or operator of the trash transfer station to give the health officer free access to the property at reasonable times for the purpose of making such inspections as are necessary to determine compliance with the requirements of this article, and regulations promulgated hereunder.
(c) 
The health officer is hereby authorized and directed to make such inspections as are necessary to determine satisfactory compliance by the owner or operator of the trash transfer station with those further restrictions or regulations which may be attached to the grant of a special exception by the township zoning board of adjustment for the operation of a trash transfer station.

(a) 
Before the operation of a trash transfer station begins, the area shall be treated for insects and rodents. The assurance of this shall be given to the township board of health to prevent insects and rodents from migrating to nearby farms, homes, industries or commercial establishments. This treatment shall be made at least twice a month or more frequently if conditions warrant.
(b) 
In order to prevent dust, all areas shall be paved or covered with crushed stone, for which a scheme shall be submitted for approval by the health officer and the township engineer.
(c) 
A six (6) foot minimum height chain link fence shall be installed around the boundaries of the premises and the gate shall be securely fastened during inoperative hours.
(d) 
Adequate water supply and provision for a fire hose to wash down the premises shall be provided. Such clean up, inside and outside of the premises, must be done on a daily basis, or more frequently if conditions warrant.
(e) 
No overnight storage of full or partially loaded trash trucks, trailers, or compactors shall be permitted. The manner of conducting the operation shall be such that no odors will be emitted from the premises at any time.
(f) 
All vehicles used by any collectors for dumping shall be equipped with compacting devices or equivalent types of closed bodies and shall have enclosed cargo space. No open body trucks will be permitted at any trash transfer station.
