This article applies to all persons or entities intending to modify access to public Town roads and/or right-of-way, except where specifically noted herein. Persons or entities are obligated to comply with other applicable Town ordinances, whether or not specifically referenced in this article. This article repeals and replaces any previously adopted Town ordinance as to those matters that are provided for in this article.
A. 
A driveway modification to existing driveways may require an access permit from the Town if the property owner is proposing to perform any of the following activities:
(1) 
Realign a single driveway to any location within the limits of the property for which the existing driveway previously served.
(2) 
Combine two single driveways on individual properties for use as common driveway or otherwise change the use of a particular existing driveway access.
(3) 
Gravel or pave an existing driveway or otherwise increase drainage to an existing Town road right-of-way.
(4) 
Replace an existing culvert below any functioning or nonfunctioning driveway, for driveway culverts within Town right-of-way or easement.
(5) 
Perform extensive construction operations alongside an existing functioning driveway of the property, including construction of features that limit the access of the property for emergency vehicles.
(6) 
Resurface an existing functioning driveway in a manner that alters the drainage characteristics or access features of the existing driveway.
B. 
The application requirements, fees and permit form(s) for such activities are included herein.

The Town Engineer is hereby authorized to administer this article of this chapter. Completed application for permits shall be filed with the Town Clerk, who shall forward the applications to the Town Engineer. The Town Engineer, within 10 days after the application is filed with the Clerk, shall approve, conditionally approve or deny the application. Any approval or denial shall be based upon pertinent standards and regulations set forth in this chapter of the Town's Code and accepted engineering standards. The Town Engineer's approval or denial shall reference specific findings for his/her decision. If denied, the applicant shall be entitled to appeal as provided in § 345-11.
Any person or entity that wishes to modify an existing driveway that accesses a Town road shall follow the Town's access permit procedures as provided in Article III of this chapter.
Such requirements are provided in § 345-26, Requirements for access permits, of this article.
Driveway standards are provided in §§ 345-27 through 345-31 of this article.
The provisions for construction work completed prior to the permit being issued are as follows:
A. 
The owner may be subject to fines and forfeitures as per § 345-12.
B. 
The owner may be required to remove all or portions of the work that was completed without a permit.
C. 
The contractor may be subject to review per the Town's qualified contractor certification procedures (Chapter 185, Contractor Certification).
