No person shall camp upon or erect any tents, huts or shelters upon any public lands under the jurisdiction of the Town of Fenwick Island, Delaware, or private property in the Town of Fenwick Island, Delaware. Each and every day any such person shall camp upon or erect any tents, huts or shelters upon any such public lands or private property shall be treated and considered as a separate and distinct offense.

A. 
Definition. As used in this section, the following terms shall have the meanings indicated:
SMOKING
The burning, heating, inhaling or exhaling of a cigarette, cigar, pipe or other product or device that contains tobacco, herbs, weeds and/or marijuana, including the use of e-cigarettes and vaporizers.

B. 
Smoking is prohibited in the following areas:
(1) 
Town parks.
(2) 
Beach.
C. 
Signage required. No person shall be prosecuted for violation of this section unless signs, readily visible to the public, are posted in appropriate areas at or near the entrance(s) to those areas where smoking is prohibited.
D. 
Enforcement. A first violation of this section will result in a written warning. Subsequent violations shall result in the imposition of fines and penalties in accordance with § 116-8 of this chapter.

It shall be unlawful for any person to sell or solicit the sale of anything on any part of the public beaches or public streets within the corporate limits of the Town of Fenwick Island, Delaware, unless such activity is approved by Town Council.

It shall be unlawful for any person to sleep, lie or loiter on any part of the public beaches within the corporate limits of the Town of Fenwick Island, Delaware, between 12:00 midnight and 8:00 a.m. local time.
It shall be unlawful for any person to live, dwell, cook, sleep, change clothes or use toilet facilities inside any vehicle within the corporate limits of the Town of Fenwick Island, Delaware.

It shall be unlawful for any person to tailgate from any vehicle or picnic on any street or highway within the corporate limits of the Town of Fenwick Island, Delaware, between the hours of 12:00 midnight and 6:00 a.m. For the purposes of this chapter, "tailgating" shall mean standing or sitting and eating or drinking on any street or highway and using the vehicle as a picnic facility.

It shall be unlawful for any person to occupy any vehicle parked on any street or any parking area generally available to the public within the corporate limits of the Town of Fenwick Island, Delaware, between the hours of 12:00 midnight and 6:00 a.m.

Any person violating any provision of this article, upon conviction, shall be fined $50 plus court costs for each and every offense.

A. 
Definition. An unmanned aircraft system (UAS) , sometimes called a "drone," is an aircraft without a human pilot on board, instead controlled by an operator on the ground.
B. 
UAS operation the Town of Fenwick Island shall follow Federal Aviation Administration (FAA) and Delaware (Chapter 421, Title II, Section 1480) regulations.
