Where conditions are such as to make smoking a hazard in any
areas of piers, wharves, warehouses, stores, industrial plants, institutions,
places of assembly and in open spaces where combustible materials
are stored or handled, the Fire Marshal is empowered and authorized
to order the owner or occupant, in writing, to post "No Smoking" signs
in each building, structure, room or place in which smoking shall
be prohibited. The Fire Marshal shall designate specific safe conditions,
if necessary, in any building, structure or place where smoking may
be permitted.
"No Smoking" signs of approved-size lettering and in locations required in accordance with §
231-16 shall read "By Order of the Fire Marshal," except that signs which were installed prior to October 1, 2000, may read "No Smoking."
It shall be prohibited for any person to remove any legally
required "No Smoking" sign or to smoke in any place where such signs
are posted.
