No motor vehicle may be operated upon the beach between May 15 and September 15, both inclusive, in each year except between the hours of 6:00 p.m. and 9:00 a.m., except as herein provided and except that motor vehicles may operate in the area approximately 2 1/4 miles east of Roanoke Landing to Reeves Cove at Reeves Farm at any time for the purpose of sport fishing only.
A. 
No motor vehicle may be operated on the beach at any time unless same is duly registered by a State Motor Vehicle Bureau.
B. 
No motor vehicle may be operated upon the beach at any time by a person who is not duly licensed to operate a motor vehicle by a State Motor Vehicle Bureau.
C. 
No motor vehicle may be operated upon the beach at any time by any person unless a permit has been issued by the Town of Riverhead for such use pursuant to § 211-7.
D. 
No motor vehicle may be operated upon the beach by any person unless the motor vehicle is insured under a valid automobile liability insurance policy carrying the limits of at least $25,000/$50,000.

E. 
No motor vehicles may be operated on the shores of the Peconic Bay beaches at any time.

The following motor vehicles may be operated at any time upon the beach without a permit:
A. 
Motor vehicles of the United States of America, the State of New York, the County of Suffolk, the Town of Riverhead and of any agency, instrumentality or department thereof when used on official business, or motor vehicles operated by officers or employees of such governmental agencies when used on official business.
B. 
Motor vehicles commandeered for use by peace officers in the performance of their duties.
C. 
Ambulances or motor vehicles used as ambulances.
D. 
Motor vehicles owned or operated by public utilities subject to the jurisdiction of the Public Service Commission.
E. 
Motor vehicles operated by a fire department of the district in the performance of its duty.

No motor vehicle, except those designated in § 211-4, shall be operated upon the beach, in a Town-owned/leased parking field or a Town-owned/leased park at a speed in excess of 10 miles per hour, except in areas where a lesser speed has been posted pursuant to a law, ordinance, local law, rule or regulation.
No motor vehicle shall be operated upon the beach for the use of towing any person on, in, through or over the waters of the Long Island Sound or the Peconic Bay.

A. 
The Recreation Department is hereby authorized to issue a permit for the use or operation of a motor vehicle on the Sound beach to qualified residents or taxpayers of the Town of Riverhead, upon showing the following proof of residency:
(1) 
Seasonal resident beach parking permit pursuant to § 211-14B(1);
(2) 
A valid tax receipt stub for the current year for any taxable real property within the Town of Riverhead assessed in the name of the applicant;
(3) 
A valid New York State motor vehicle registration license in the name of the applicant and with an address located within the Town of Riverhead. A post office box address is not acceptable proof of residency; or
(4) 
Such other proof of residency as is satisfactory to the Riverhead Recreation Department.
B. 
The Town Board, by resolution, shall establish the annual fee for a permit to operate a motor vehicle on the Sound beach and determine the period of time a permit shall be valid. The applicant shall furnish the following information:
(1) 
The name of the applicant and address of the applicant's dwelling or residence.
(2) 
The applicant's driver's license number, date of issuance, date of expiration and state of motor vehicle bureau issuing such license.
(3) 
The make, model and year of the vehicle for which the permit is sought and the current registration number and state of registration of said motor vehicle.
(4) 
The name of automobile liability insurance company, policy number and expiration date of policy.
(5) 
Whether a previously issued permit hereunder has ever been suspended or revoked, and if so, the circumstances thereof.
C. 
The operation of trikes, motorbikes, minibikes or any other two-, three- or four-wheeled fuel-powered vehicle and all-terrain vehicles (ATVs), as defined in Article 48-B of the Vehicle and Traffic Law, shall be prohibited on any beach within the Town of Riverhead.
D. 
The Recreation Department is hereby authorized to issue permits for the use or operation of a motor vehicle on the Long Island Sound beach to a duly organized fishing club. The club must be recognized and approved by the Town Board and certified by the Town Clerk. Said permit shall be issued for a fee set by the Riverhead Town Board per permit. The duly organized fishing club is authorized to receive permits equal to 10% of its active membership. The permit shall be conspicuously displayed on the dashboard of the motor vehicle being used by a club member. A fishing club permit shall allow parking in spaces provided during the hours of between 6:00 p.m. and 9:00 a.m. at any public bathing beach. A permit issued pursuant to this section shall not authorize the permit holder to park at any other time; instead, a resident or nonresident parking permit is required for parking at all other times.

The permit required hereunder shall be permanently affixed and prominently displayed on the vehicle for which the permit was issued by being affixed on any driver's side window.

The Town Board, by resolution, shall determine the period of time a permit shall be valid.

A. 
No person shall throw, deposit or abandon litter on any beach, dune or adjacent property or waters along the Sound Beach or Peconic Bay Beach or any creek, inlet, pond or river, whether public or private or whether owned or not owned by such person.

B. 
When litter is in the immediate vicinity of any individual and that individual has other property in his immediate possession which is of the same brand name, such person or persons shall be presumed to have caused such litter in their immediate vicinity to be abandoned.

Any violation of this article shall be deemed to be an offense punishable by a fine of not less than $250 and not to exceed $500 or 10 days in jail, or both. Upon conviction for any violation of § 211-2, 211-3 or 211-6 of this article, the permit issued hereunder shall be automatically revoked by the presiding Magistrate. No permit which has been revoked shall be reissued within a period of one year from the date of such revocation. Upon conviction for a violation of any other provision of this article, the permit issued hereunder shall be automatically suspended for a period of one month from the date of suspension.

In addition to any other penalty imposed herein, the motor vehicle used in violation of this article shall be impounded by the Riverhead Town Police Department. No such impounded vehicle shall be released until a payment, in an amount as set from time to time by Town Board resolution, shall have been paid to the Town of Riverhead. No owner of such impounded vehicle shall have any civil claim against the Town of Riverhead for such impoundment pursuant to this section.
