The Board of Trustees of the Incorporated Village of East Hills
does hereby enact this chapter, which shall be known and cited as
"Administration and Enforcement of Building and Zoning Codes."
The purpose of this chapter is to ensure compliance with the
New York State Uniform Fire Prevention and Building Construction Code, the Nassau County Fire Prevention Code and Chapter
271, Zoning, to educate the public that the community is serious about safety standards, to protect the citizens and to install confidence that public safety has been provided for.
In their interpretation and application, the provisions of this
chapter shall be held to be the minimum requirements adopted. Whenever
this chapter imposes greater restrictions than are imposed or required
by existing provisions of law or ordinance or by any other rules,
regulations or permits adopted or issued at any time, the provisions
of this chapter shall control. Whenever the requirements of this chapter
differ from the requirements of another existing local law of the
Village, then the more drastic shall govern.

A. A lot held
in single and separate fee ownership, which was conforming at the
time a new ordinance was adopted or amended, but thereafter became
a nonconforming lot by having street frontage, area, or width at the
building line less than required by the adoption or amendment of a
new ordinance, shall be exempt from complying with the new minimum
area ordinance.
B. If an application
for a building permit is made to construct a building or structure
upon a nonconforming lot, no variance shall be required to authorize
the issuance of the requested building permit so long as the proposed
structure, by itself, does not violate any of the requirements of
the regulations in effect at the time of the application.
