No building permit shall be issued in the Town of Williamson
for a use requiring site plan review prior to the review and approval
of an application for a special use permit and its supporting documentation
by the Planning Board, in accordance with the provisions of this article.
In cases where an amendment is sought for a site plan previously reviewed
and approved by the Town of Williamson Planning Board, the applicant
shall also secure approval from the Planning Board where such amendment
is proposed. No certificate of occupancy shall be issued for the construction
of any building or use of land where site plan review is required
under this article unless said building or land use is in conformity
with the approved site plan or amendment thereto.
The applicant shall meet with the Planning Board and review
the various requirements of this article prior to presenting a formal
site plan for review. Prior to the meeting, the applicant will provide
the Planning Board with both an existing conditions map of the subject
parcel and a general concept site plan for the proposed land use and
building construction on the subject parcel. The applicant is allowed
to meet informally with the Board on one occasion.
An application for a special use permit shall be accompanied
by a detailed final site plan and submitted to the Town of Williamson
Building and Zoning Officer. The applicant shall provide sufficient
copies of the required submission as determined by the Planning Board
during the concept phase of site plan review. The Building and Zoning
Officer shall review the submitted materials to determine whether
the information required in this article has been provided by the
applicant. Should the application be deemed incomplete by the Building
and Zoning Officer, the reasons for the denial shall be provided to
the applicant in writing. Upon the receipt of a complete application,
the Building and Zoning Officer shall refer the full application package
to the Planning Board with a written statement that the application
is substantially complete. A complete application shall comply with
the following provisions:
A. Map. A map shall be prepared by a licensed engineer, landscape architect,
surveyor or architect, which map shall be drawn to scale and accurately
dimensioned. The map, or set of maps, shall show the following:
(1) Existing conditions. The following shall be shown:
(a)
The location of all property lines.
(b)
The location of any easements.
(c)
The location and use of existing structures on the lot.
(d)
The location and use of existing structures on all lots neighboring
the subject parcel or across a public or private street or utility
right-of-way from the subject parcel.
(e)
The location of streams, watercourses, delineated wetlands,
ponds, lakes, marshes or wooded areas on the lot that should be preserved
to the extent practicable.
(g)
The location of public, private and/or paper streets.
(h)
The location of public utilities.
(2) Proposed development. The following shall be shown:
(a)
The location and use of all land and buildings.
(b)
Parking and loading areas, vehicular and pedestrian access and
circulation.
(c)
The location of utility lines.
(d)
The location of stormwater treatment and/or retention areas,
if applicable.
(e)
Proposed grading, lighting, screening, drainage and landscaping.
B. Documents to aid the Planning Board in its requisite duties under
the New York State Environmental Quality Review Act, including but
not limited to Part I of a short environmental assessment form, Part
I of a full environmental assessment form or a draft environmental
impact statement, as well as documentation supporting any and all
assertions made in these submissions.
C. Other: any other information deemed necessary by the Planning Board
in its review of the site plan.
Approval of a final site plan by the Town of Williamson Planning
Board shall be valid for a period of one year from the date of approval,
or from the date on which the applicant addresses any and all conditions
imposed upon the site plan approval, to the satisfaction of the Planning
Board, to obtain a building permit. The Planning Board shall establish
a set period of time for an applicant to adequately address any and
all conditions imposed upon an approved site plan. Upon application,
the Planning Board may extend the time limit of the validity of the
site plan approval for an additional one year. The Planning Board
shall not grant more than two one year extensions on an approved site
plan. Responsibility to obtain a building permit or secure an extension
of site plan approval within the time periods listed herein is the
sole responsibility of the applicant. Failure to obtain a building
permit within the time periods set forth herein shall cause the granted
site plan approval to be null and void.
