The position of superintendent of public works of the Borough
of Morris Plains heretofore established is hereby continued.

The superintendent shall be appointed and shall hold office
in the manner and for the term provided for in R.S. 40:87-30 and 40:87-15.

Nothing in this article shall adversely affect the tenure rights
of the incumbent in the position of superintendent provided for in
R.S. 40:87-30.2 or any other rights provided by law at the time of
passage of this article.

In addition to the powers and duties established by state statutes
and the ordinances of the Borough of Morris Plains, the superintendent
shall be chargeable with the overall supervision and administration
of the road department of the Borough of Morris Plains heretofore
established and the members thereof. The superintendent shall formulate
and execute plans for the effective utilization of available funds,
personnel, equipment, materials and supplies. He shall organize and
develop suitable work programs for the varied functions of the road
department. He shall give suitable assignments and instructions to
the members of the road department and shall supervise their work.
He shall make investigations of complaints and shall take proper action
to accomplish repairs with a minimum of delay. He shall prepare and
keep suitable reports, records and findings and shall safeguard and
supervise proper use of needed equipment, materials and supplies.
The superintendent shall organize the personnel of the Road Department
in a suitable manner to accomplish all of the above.

The Superintendent, from time to time as may be necessary, shall
develop rules and regulations for the safe and efficient operation
of the Road Department and the members thereof. Said rules and regulations
shall fix and provide for the enforcement of penalties for the violation
of same, and the members of the Road Department shall be subject to
such rules, regulations and penalties. The rules, regulations and
penalties developed by the Superintendent shall not become effective
until adopted by the Borough Council by resolution.

The Superintendent shall enforce the rules, regulations and
penalties so adopted by the Borough Council. To this end, he may discipline
any member of the Road Department who violates the rules and regulations
adopted by the Borough Council. The Superintendent may discharge an
employee only with the approval of the Borough Council. In addition,
the Superintendent is hereby authorized to hire, upon approval of
the Borough Council, a sufficient number of Road Department employees
to ensure the efficient operation of the Road Department.

The Superintendent shall perform such other duties as may be
assigned by the Borough Council by resolution.

The Superintendent shall receive such salary as the Borough
Council may fix from time to time by ordinance.

(a) The position of Assistant Superintendent of Public Works of the Borough
of Morris Plains heretofore established is hereby continued.
(b) The Assistant Superintendent shall be appointed in the manner provided
for in N.J.S.A. 40A:9-9.
(c) The Assistant Superintendent shall assist the Superintendent in the
supervision and administration of the Road Department of the Borough
of Morris Plains. The Assistant Superintendent shall serve in the
stead of the Superintendent and shall have all the powers and duties
of the Superintendent whenever the Superintendent is absent from his
post of duty due to illness, vacation or otherwise authorized leave.
(d) The Assistant Superintendent shall receive such salary as the Borough
Council may fix from time to time by ordinance.
