The Shade Tree Commission as heretofore established is hereby continued.

The Commission shall consist of 5 members appointed by the Mayor and who shall serve without compensation.[1]

The Commission shall have the power of regulation, planting, care and control of shade and ornamental trees and shrubbery upon and in the streets, highways, parks and parkways in the Borough in accordance with N.J.S.A. 40:64-1 et seq.[1]

Editor's Note: N.J.S.A. 40:64-1 provides that jurisdiction of trees and shrubbery on state highways and county roads is retained respectively by the state department of transportation and by the county shade tree commission, if one has been created, unless the Borough has received assents by these agencies as to release of jurisdiction regarding trees and shrubbery.
