The Village of Scotia has experienced significant problems with
the discharge of snaps, party poppers, party string and stink bombs/spray
during certain events that draw large numbers of spectators and participants.
Used snaps and poppers litter parks and other municipal property and
because of their minute pieces are impossible to completely clean
up. Party string has been discharged upon the streets, sidewalks,
adjoining properties and on persons and created a nuisance. Party
string and stink bomb/spray containers litter the streets, sidewalks
and parks and also stain and disfigure concrete and other objects
when discharged. Both party string and stink bombs/spray have created
an extremely offensive atmosphere for spectators and members of the
public. These effects have been confirmed by members of the public,
property owners, the Village Police Department and Department of Public
Works. It is the intent of this law to protect the public health,
safety and welfare.
As used in this chapter, the following terms
shall have the meanings indicated:
PARTY POPPERS
An amusement product that typically contains confetti and/or
streamers that explode from its container when activated, also known
as "confetti poppers."
PARTY STRING
An amusement product that ejects from a container a foam-like
substance that, after being expelled, resembles a string or a string-like
material commonly known as "party string" or "Silly String" or other
product names.
SNAPS
An amusement product that has a small amount of explosive
wrapped in paper or other product that has a "snap" sound when thrown,
hit or stepped on, also known as "Throw Snappers," "Party Snaps."
STINK BOMBS/SPRAY
An amusement product that, when sprayed or upon being activated
or opened, emits a foul repulsive odor.
No person, corporation or entity shall sell or offer to sell
party string, stink bombs/spray, snaps or party poppers, or other
similar amusement products that the use thereof creates litter, on
the day of the annual Memorial Day parade conducted the Wednesday
before Memorial Day or on the day of the annual public fireworks display
conducted the Friday before the fourth of July or Halloween.
No person shall discharge or open party string, stink bombs/spray,
snaps or party poppers as defined in this chapter in or along any
street, sidewalk, park, public parking lot, places of business or
other public places in the Village of Scotia on the day of the annual
Memorial Day parade conducted the Wednesday before Memorial Day or
on the day of the annual public fireworks display conducted the Friday
before the fourth of July or Halloween.
Any person who violates any provision of this
chapter shall, upon conviction thereof, be guilty of a violation and
shall be subject to a fine not to exceed $250 or imprisonment for
a term not to exceed 15 days, or both.
