No person shall park, let stand or permit a motor vehicle to
be in an area or street designated pursuant to this article to be
a restricted residential parking area from Monday through Friday,
inclusive, from 6:00 a.m. through 6:00 p.m., for more than one hour
except in compliance with this article.
For purposes of this Article
XII, the following terms shall
have the following meanings:
BLOCKFACE
All properties on one side of a designated street existing
between two named intersecting streets, which is in a restricted residential
parking area.
CERTIFIED RESIDENT
A full-time owner, occupant having fee simple title to real
property or a renter who has valid lease to such real property.
COMMUTER VEHICLE
A motor vehicle parked in a restricted residential parking
area which does not have a residential parking permit.
HOUSEHOLD
All persons occupying a dwelling unit.
INFLUENCE AREA
The area surrounding or near a facility in which it could
reasonably be expected that nonresident motor vehicle owners or operators
using the facility would seek parking spaces.
LEASE
Shall apply to a person who pays a fair rental value for
the residential occupancy of a residence in a blockface.
MOTOR VEHICLE
Any automobile, truck or motorcycle for which registration
and/or licensing is required by the Pennsylvania Department of Transportation.
RESIDENT VEHICLE
A vehicle for which a permit has been issued pursuant to
this article.
RESTRICTED RESIDENTIAL PARKING AREA
That street or one side of a street designated by Wilmerding
Borough Council by resolution from time to time as a restricted residential
parking area pursuant to this article.
Borough Council may hereinafter by simple resolution designate
any public street or streets to be a restricted residential parking
area. Such areas shall be posted with street signs which shall state
that those areas are limited to one-hour parking except for those
motor vehicles displaying an official permit issued by the Borough
Secretary of Wilmerding Borough pursuant to this article, the days
and the hours of each day when the restricted parking shall be enforced.
An area shall be designated as a restricted residential parking
area by Borough Council by simple resolution pursuant to the following
criteria:
A. It shall be determined by investigation, observation and input from
residents that the influence area of a facility is impacted by commuter
vehicles for extended periods of time during the day or night, on
weekdays, weekends or during holidays.
B. Certified residents in the blockface of the area have indicated their
willingness to apply for and pay for a permit if necessary to allow
them to park longer than the one-hour limit.
C. The availability of other parking space in the area for residents
and commuter vehicles.
D. The extent to which commuter vehicles occupy such parking areas in
excess of one hour.
Once an area has been designated as a restricted residential
parking area and the area has been posted, the Borough Secretary shall
issue permits to certified residents, as follows:
A. Permits shall be issued on a yearly basis and shall expire on December
31 of each year. There shall be no fee charged for such permits. However,
a permit fee may be imposed from time to time by Borough Council by
simple resolution.
B. A permit shall be issued for one passenger car or motor vehicle,
and the signed application for the permit shall include the make,
model, color, year, VIN and registration, license number and the names
of all owners of each motor vehicle. There shall be no more than two
permits per household.
C. The Borough Secretary may demand proof of ownership of a motor vehicle
and real estate within the blockface as he deems prudent and reasonable.
D. Certified residents having a residential visitor may apply to the
Chief of Police for permission for such guest to park during restricted
hours for a time not to exceed two hours in any single day.
Parking permits shall be prominently displayed at all times
when a motor vehicle is parked in a restricted residential parking
area. Commuter vehicles parked in such area contrary to this article
shall be subject to a fine.
A. Any police officer or other personnel authorized by the Mayor or
Borough Council to enforce parking regulations or ordinances is authorized
and directed to enforce this article by ticketing such unlawfully
parked motor vehicles by affixing such ticket to the motor vehicle
with all relevant information regarding the violation in the same
manner as other parking violations in the Borough.
B. Each one-hour period during which a motor vehicle remains parked
in a restricted residential parking area beyond the permissible one-hour
parking shall be deemed to be a separate offense. The fine is hereby
set at $10 for each violation, payable to the Borough Secretary during
regular business hours. Any person who fails to pay the ticket within
15 days shall be subject to prosecution and, upon conviction, shall
be subject to a fine of $100.
C. A resident motor vehicle on or in which is displayed a valid parking
permit as provided for herein shall be permitted to stand or be parked
in the restricted residential parking area without being limited by
the time restrictions established herein. All other motor vehicles,
except emergency vehicles, shall be subject to the time restrictions
and penalties provided for herein. A parking permit shall not guarantee
or reserve a permit holder a designated parking space within the area.
Certified owners of residential properties in a blockface may secure
special permission for their guests to park without a residential
parking permit for no more than two days.
