A. Words and phrases used in this chapter concerning traffic shall have
the meanings respectively ascribed to them in Title 39 of the New
Jersey Statutes Annotated.
B. Official time standard. Whenever certain hours are named in this
chapter, they shall mean either Eastern standard time or Eastern daylight
saving time or such other officially designated and recognized standard
as may be in current use in the Borough.
C. Public holidays. Whenever a "public holiday" is referenced in this
chapter, it shall mean any of the days listed in § 28-15
of Chapter 28, Personnel Policies, of this Code, for the entire twenty-four-hour
period of such days.

D. Overnight parking. Whenever the term "overnight parking" is referenced
in this chapter, it shall refer to the time period between 12:01 a.m.
to 6:00 a.m.

A. The Mayor or, in his/her absence, disability or inability to act,
the Certified Public Works Manager, and, in the event of his/her absence,
disability or inability to act, then the New Jersey State Police,
is hereby authorized to provide regulation for the closing of any
street or portion thereof to motor vehicle traffic on any day or days
during specified hours on any day or days whenever he/she finds that
such closing is necessary for the preservation of the public safety,
health and welfare.
B. Any regulation promulgated by the Mayor and in accordance with Subsection
A above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
C. Any regulation adopted that mandates the closing of any street for
a period greater than 48 consecutive hours shall not become effective
unless and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.
D. Any closure of county roads would require Freeholder (or appropriate
designee) approval.
The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping, standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138 or any other New Jersey
statute or as hereinafter provided.
Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and the New Jersey State Police and the Zoning Officer may provide
for the removal of that vehicle. The vehicle owner shall bear the
reasonable costs of the removal and storage which may result from
such removal before regaining possession of the vehicle.
Unless another penalty is expressly provided by New Jersey statute,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable to a penalty of not more
than $50 or imprisonment for a term not exceeding 15 days, or both.
All former traffic ordinances of the Borough are hereby repealed,
and all ordinances or parts of ordinances in conflict with or inconsistent
with the provisions of this chapter are repealed, except that this
repeal shall not affect or prevent the prosecution or punishment of
any person for any act done or committed in violation of any ordinance
repealed prior to the taking effect of this chapter.
Upon the declaration of an emergency, there shall be no parking
upon public streets or sections of streets where temporary EMERGENCY
NO PARKING signs are displayed. The Certified Public Works Manager
or, in his/her absence, the New Jersey State Police is authorized
to declare an emergency and to direct the posting of EMERGENCY NO
PARKING signs when weather conditions, accidents, road construction,
fire or public celebrations dictate or require avoidance of hazards
or other conditions which interfere with the free flow of traffic.
Notice that EMERGENCY NO PARKING signs are being or will be posted
shall be given to the operator or owner of any vehicle which has been
parked prior to the posting of signs.
A. Whenever snow has fallen and the accumulation is such that a state
of emergency has been declared or issued for streets or highways,
an emergency shall exist, and no vehicle shall be parked on streets
or highways or portions thereof as indicated.
B. The above parking prohibitions shall remain in effect after the snow
has ceased and until the streets have been plowed sufficiently and
to the extent that parking will not interfere with the normal flow
of traffic.
C. Any unoccupied vehicle parked or standing in violation of this provision
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic, and the New Jersey State Police and the Zoning Officer
may provide for the removal of that vehicle. The vehicle owner shall
bear the reasonable costs of the removal and storage which may result
from such removal before regaining possession of the vehicle.

unlawful to park any vehicle overnight on any lot which is owned by
the Borough of Milford, unless by permit only.

A. Municipal lot parking; permits for Borough residents and tenants.
The Clerk of the Borough of Milford shall be authorized to issue parking
permits which shall be issued, displayed and remain valid in accordance
with the following requirements for parking in the Borough's
municipal parking lots located off Bridge Street between Block 19,
Lots 2 and 4, and the lot adjacent to the Milford Presbyterian Church,
Block 19, Lot 19 (the "municipal lots"):
(1) Qualification. Permits shall be issued only to residents of Bridge
Street, including both homeowners and residential tenants, who have
no on-site parking at their place of residence.
(2) Proof of applicant's eligibility for permit issuance. Proof
of eligibility shall be provided at the time of application, and shall
consist of: for residents, a valid New Jersey driver's license
showing the applicant's address of residence and information
regarding the applicant's vehicle; for tenants, a signed and
currently valid lease evidencing the applicant's address of residence
within the Borough, or a letter from the landlord/property owner acknowledging
the existence of the tenancy within the Borough, or a New Jersey driver's
license with the applicant's address, and information regarding
the applicant's vehicle.
(3) Term of permit. Permits shall be issued on an annual basis, valid
from January 1 to December 31 of each year. If, while the application
is pending or during the term of any permit granted thereunder, there
is any change that would alter the information given in the application,
the applicant shall notify the Borough Clerk, in writing, within 24
hours following such change. If any permit-holder ceases to be a resident
or a tenant of Bridge Street the permit shall be returned to the Borough
Clerk and the permit shall no longer be valid.
(4) Duration of parking. During the term of the permit, no permitted vehicle for residents or tenants shall remain in the municipal lots for three or more days without being moved. In the event of a resident or tenant's emergency or vacation, the owner of the vehicle shall notify the Borough Clerk. Any vehicle not moved after three days may be towed by the Borough at the vehicle owner's sole expense in accordance with §
181-4. Permitted vehicles must be moved within 12 hours after the cessation of any snow event to enable the unobstructed plowing of the municipal lots.
B. Municipal lot parking: permits for business owners and employees.
The Clerk of the Borough of Milford shall be authorized to issue parking
permits which shall be issued, displayed and remain valid in accordance
with the following requirements for parking in the Borough's
municipal parking lots located off Bridge Street between Block 19,
Lots 2 and 4, and the lot adjacent to the Milford Presbyterian Church,
Block 19, Lot 19 (the "municipal lots"):
(1) Qualification. Permits shall be issued only to owners and employees
of businesses located on Bridge Street which have no on-site parking.
(2) Proof of applicant's eligibility for permit issuance. Proof
of eligibility shall be provided at the time of application, and shall
consist of, for business owners and their employees, a notarized statement
by the business owner, on forms supplied by the Borough Clerk, attesting
to the eligibility of the applicant and the lack of on-site parking
for that business address; and shall include information regarding
the applicant's vehicle.
(3) Term of permit. Permits shall be issued on an annual basis, valid
from January 1 to December 31 of each year. If, while the application
is pending or during the term of any permit granted thereunder, there
is any change that would alter the information given in the application,
the applicant shall notify the Borough Clerk, in writing, within 24
hours following such change. If any permit-holder ceases to own a
business on Bridge Street, or is no longer employed by a business
on Bridge Street, the permit shall be returned to the Borough Clerk
and the permit shall no longer be valid.
(4) Permitted hours. Permits issued for business owners and their employees under Subsection
B hereof shall be permitted to park in the municipal lots during "normal business hours," which are set forth as 7:00 a.m. to 6:00 p.m. Permits issued for business owners and their employees shall not entitle business owners or their employees to park their permitted vehicles overnight in the municipal lots.
C. General provisions.
(1) The following provisions are applicable to permits issued under Subsections
A and
B above:
(a)
Fee. The fee for parking permits in the lot shall be $5 per
permit period and shall be paid at the filing of the application.
(b)
Nontransferability. The parking permits shall not be transferable.
(c)
Display. The parking permit shall be displayed on the dashboard
(driver's side) of the vehicle. If the parking permit is not
conspicuously displayed, the vehicle owner shall be found in violation
of this ordinance.
(d)
Prohibited parking of certain trucks, trailers and vehicles.
No person shall park any vehicle over three tons gross weight (GVW),
any school bus, any commercial vehicle, or any other type of bus,
recreational vehicle, camper, boat or trailer on the municipal lots.
(e)
Prohibited activities. The municipal lots shall be used exclusively
by any permit holder for the parking of a permitted vehicle. No routine
cleaning and maintenance nor repair of any kind is to occur in the
municipal lots, and any such prohibited activity shall be a violation
of this section.
(2) Penalties. Unless another penalty is expressly provided for by New
Jersey statute, every person convicted of a violation of this section
or any supplement thereto shall be liable to a penalty of not more
than $100 per occurrence or imprisonment for a term not exceeding
15 days, or both.
(3) All ordinances or parts of ordinances which are inconsistent with
the terms of this section be and the same are hereby repealed to the
extent of their inconsistency.
