For the purposes of this article, the following terms shall
have the meanings indicated:
IMPROVED PROPERTY
Any property abutting on Adrian Road, French Road, Barbara
Road and Katherine Road in the Perkiomen Village Subdivision in Perkiomen
Township upon which there is a structure erected for habitation by
human beings.
The owners of all improved properties as described in §
301-1 of this article shall connect to the public water distribution system to be installed by the Perkiomen Township Municipal Authority ("the water system") within 90 days after notice from Perkiomen Township to connect.
The connection to the water system shall include the installation
of a water meter, including an access outlet for connection to a telephone
line required for remote meter reading. Meters shall be the type of
meter specified and provided by the Perkiomen Township Municipal Authority
at the owner's expense.
Upon connecting to the water system, existing on-site well water
supply facilities shall be disconnected. Crossover connections between
the water system supply and existing on-site well water supply facilities
are prohibited. Existing on-site well water supply facilities may
continue to be used only for lawn and garden watering and washing
cars. In all other respects, connections to the water system shall
comply with the requirements of the Uniform Construction Code, adopted
by the provisions of Township Ordinance No. 180.
If any owner of an improved property abutting the water system
fails to connect with and use the water system within 90 days after
notice to do so has been given by the Board of Supervisors, the Perkiomen
Township Municipal Authority, as agent for the Board of Supervisors,
is hereby authorized and directed to enter upon the improved property
and construct the connection. The Perkiomen Township Municipal Authority
shall send an itemized bill for the cost of construction of the connection
to the owner of the improved property to which the connection has
been made, which bill shall be payable immediately.
The owner of any improved property connected to the water system by the Perkiomen Township Municipal Authority at the direction of the Board of Supervisors, as authorized by §
301-5 of this article, may make application to the Perkiomen Township Municipal Authority to make payment of the cost of the connection to the water system in installment payments, pursuant to resolution of the Municipal Authority and the guidelines and procedures established thereby.
Any person who violates or permits a violation of this article
shall, upon conviction in a summary proceeding brought before a Magisterial
District Judge under the Pennsylvania Rules of Criminal Procedure,
be guilty of a summary offense and shall be punishable by a fine of
not more than $1,000 plus costs of prosecution. In default of payment
thereof, the defendant may be sentenced to imprisonment for a term
not exceeding 90 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate
offense, and each section of this article that is violated shall also
constitute a separate offense.
