As used in this article, the word "person" shall be construed
to mean any natural person, association, partnership, firm, organization
or corporation. The singular shall include the plural, and the masculine
shall include the feminine and neuter.
Whenever it is found that any person is maintaining a nuisance as defined in §
241-4A and
B of this article, any officer or employee of the Township may serve notice thereof, requiring that the condition be made safe, corrected or removed, by certified mail, addressed to such person's last known address, or by personally delivering the same.
Should any person cause or permit the continuance of a nuisance after 20 days from the date of notice given pursuant to §
241-5 of this article, the Township may, upon resolution of the Board of Supervisors, cause the removal or abatement of the nuisance by such means as may be required. The Township shall, in such event, have the right and power to enter upon the premises causing or contributing to such nuisance to accomplish the abatement thereof.
In the event the Township shall have expended monies to abate
a nuisance under the terms of this article, the Township shall recover
the cost thereof, including attorneys' fees, by municipal claim proceedings
under the Act of May 16, 1923, P.L. 207, as amended; by summary proceedings under the Act of May 1, 1933, P.L.
103, Article VII, Section 702, Clause XII, as amended; or by such other remedies as may be provided by law, at
the election of the Township.
In addition to such other remedies as are provided hereby, the
Township may institute proceedings in courts of equity to enforce
the provisions hereof.
Any person who violates or permits a violation of this article
shall, upon conviction in a summary proceeding brought before a Magisterial
District Judge under the Pennsylvania Rules of Criminal Procedure,
be guilty of a summary offense and shall be punishable by a fine of
not more than $1,000 plus costs of prosecution. In default of payment
thereof, the defendant may be sentenced to imprisonment for a term
not exceeding 90 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate
offense, and each section of this article that is violated shall also
constitute a separate offense.
