No person other than a contractor licensed under this chapter shall be issued a permit to construct, surface or resurface a driveway, paved or otherwise, within the public rights-of-way of the Town.
After obtaining a permit pursuant to this article and before commencing operations in the public right-of-way, a grade line shall be obtained from the Town Engineer.

No private driveway of over 30 feet in width, exclusive of flares, three-foot radius maximum, shall be constructed and no place or commercial driveway of over 30 feet in width shall be constructed without prior approval from the Town Engineer. Driveways existing prior to (date of approval of these changes, September 12, 2016) can be reconstructed to preexisting dimensions.
No driveway shall be authorized to be constructed within four feet of a regularly constituted crosswalk, as determined by the Town Engineer.
A. 
Approval must be obtained from the Town Engineer to install more than two driveways on one piece of property.
B. 
No two driveways, either on the same or adjoining property, shall be closer to each other than eight feet, except in the case of hardship as determined by the Town Engineer.
No driveway shall be authorized to be constructed within 20 feet of a street intersection.
A. 
No driveway apron shall extend into the street further than the gutter line unless a culvert is placed under the driveway as provided in this article.
B. 
The installation line, grade and material of such culvert shall meet the specifications of the Town Engineer.
C. 
The Town of Southington shall not be responsible for any damage in the Town's right-of-way for all new driveways constructed of concrete, brick or brick pavers. The property owner may construct driveways with these materials with the understanding that the Town will not be liable to the property owner for any damage to the driveway that is located in the Town's right-of-way. All driveways currently constructed with these materials, a portion of which is located in the Town's right-of-way, shall be repaired by the Town if the Town causes damage.

Where, in the opinion of the Town Engineer, drainage conditions require a culvert, such culvert shall be installed under the specifications as outlined in Article IX. Such culvert shall extend a minimum of two feet beyond each edge of the basic width of the driveway, and in no case shall it be less than 12 feet in length. The top side of the pipe shall be no closer than 12 inches from the surface of the driveway. Where driveways interfere with drainage of the street, as in the moving or removal of catch basins, permission shall be granted only when such change is made with the approval of the Town Engineer and according to plans prepared by a registered professional civil engineer at the expense of the contractor.
The removal of any large trees on Town property shall be carefully avoided, and plans shall be made to install driveways in such a manner that the removal of such a tree may be avoided. If in the opinion of the Town Engineer it is necessary to remove such a tree, he may authorize the contractor to so remove it, provided the contractor shall conform to all rules as set forth in Article VII of this chapter.
