[Ord. 81-10, 6/11/1981, § 1]
This Part shall be known as the "False Police Report Ordinance."
[Ord. 81-10, 6/11/1981, § 2]
No person, firm, partnership, corporation or other organization
shall report or cause to be reported any criminal offense, or give
any information relating to any alleged criminal offense, to the Susquehanna
Township Police Department, or to any member thereof, which report
or information is false and such person, firm, partnership, corporation
or other organization knows to be false.
[Ord. 81-10, 6/11/1981, § 3]
The term "false" and the phrase "knows to be false" shall include
any report transmitted to the Susquehanna Township Police Department
by electronic or other means through an alarm device owned, controlled,
operated or leased by any person, firm, partnership, corporation or
other organization, and it shall be presumed that such ownership,
control, operation or leasing includes knowledge of any false report
transmitted by electronic or other means.
[Ord. 11-04, 2/10/2011]
It shall be unlawful to cause the dispatch of a Susquehanna
Township police officer or police unit by dialing 911, intentionally
or negligently, on a repeated basis, or allowing a telephone, cell
phone, mobile phone or similar communication device to result in the
dispatch of a Susquehanna Township police unit or officer when no
emergency exists. Repeated violations shall be defined as more than
three violations in one calendar year. No charge nor fine shall occur
for the first three dispatches if unintentional or negligently done
and, thereafter, the charge fee or fine shall be set by resolution
of the Board of Commissioners of Susquehanna Township as a charge
for services based on the number of dispatches, with said charge reflecting
reasonable costs anticipated for dispatch and response, including
the full costs of anticipated police time.
[Ord. 81-10, 6/11/1981, § 4; as amended by Ord.
89-16, 11/21/1989]
Any person, firm or corporation who shall violate any provision
of this Part shall, upon conviction thereof, be sentenced to pay a
fine of not less than $10 and not more than $600 and costs, or in
default of payment thereof, shall be subject to imprisonment for a
term not to exceed 30 days.
