A permit pursuant to this chapter shall be obtained from the
Park and Recreation Board for the following purposes:
A. Reservation of any area or place in the park for special or private
use.
B. Performance of scientific or educational experiments or activities
on a continuing basis.
C. Performance of special programs of a recreational, educational or
conservation nature by private groups.
D. Relief from the regulations pursuant to this chapter where permitted,
such as parking, building fires in certain locations, operation of
vehicles, camping activities, use of the park beyond stated hours,
sale of refreshments, fishing events, or other items.
No permit shall be issued until an application has been filed
with the Park and Recreation Board at least 20 days before the date
on which any proposed activity is to take place, stating:
A. Name and address of the applicant.
B. Name and address of the person sponsoring the activity, if any.
C. Day or days and hours for which the permit is desired.
D. The area of the park for which such permit is desired.
E. Estimate of the anticipated attendance or number of persons participating.
F. Any other information required by the Park and Recreation Board necessary
to determine whether a permit should be issued.
The Park and Recreation Board shall issue a permit when:
A. The proposed activity or use will not interfere with or detract from
the general public enjoyment of the park.
B. The proposed activity or use will not entail unusual or extraordinary
expense to the Town.
C. The area or facilities desired have not been reserved for other use
at the time requested in the application.
D. The proposed activity or use will not cause damage to the park or
tend to violate any of the park regulations.
No person shall fail to produce and exhibit any permits that
he claims to have upon request of the Park and Recreation Board who
shall desire to inspect the permit for the purposes of enforcing compliance
with any ordinance or regulation. Failure to produce any permit upon
request will nullify existence of such permit.
Any permit issued pursuant to this article shall become void
upon official state closing of woodlands or if, in the opinion of
the Fire Marshal, fire hazard warrants such action.
The Park and Recreation Board shall have the authority to revoke
a permit upon a finding of violation of any ordinance or regulation,
conditions of the permit, or for good cause shown.
The person to whom a permit is issued pursuant to this article
shall be liable for any loss, damage or injury sustained by any person
whatever by reason of the negligence of the person to whom such permit
shall have been issued.
No person shall disturb or interfere unreasonably with any person
occupying any area or participating in any activity under the authority
of a permit pursuant to this article.
