The office of Borough Manager is hereby created by the Borough
of Hamburg, Berks County, Pennsylvania.

The Borough Manager (hereinafter referred to as the "Manager")
shall be appointed for an indefinite term by a majority of all members
of the Council. The Manager shall serve at the pleasure of the Council
and may be removed at any time by a majority vote of all of the members
of Council. At least 30 days before such removal is to become effective
the Council shall furnish the Manager with a written statement setting
forth its intention to remove him.

The Manager shall be chosen solely on the basis of his executive
and administrative abilities with special reference to the duties
of his office as herein outlined. The Manager need not be a resident
of the Borough of Hamburg or of the Commonwealth of Pennsylvania at
the time of his appointment but during the tenure of office he must
move to within 10 miles of the Borough of Hamburg within a reasonable
period of time to be determined by the Council.

Before entering upon his duties the Manager shall give a bond
to the Borough with a bonding company as surety to be approved by
the Council in the amount prescribed by the Borough Council conditioned
upon the faithful performance of his duties. The premium for said
bond shall be paid by the Borough.

The salary of the Manager shall be fixed from time to time by
the Council.

1. The Manager shall be the chief administrative officer of the Borough
and shall be responsible to the Council as a whole for the proper
and efficient administration of the affairs of the Borough placed
in his charge. The powers and duties for the administration of all
Borough business shall be vested in the Manager unless expressly imposed
or conferred by statute or ordinance upon other Borough Officers.
2. Subject to recall by ordinance of Council, the powers and duties
of the Manager shall include the following:
A. Supervise and be responsible for the activities of all municipal
departments. Nothing in this Part is intended, however, to apply to
the office of Borough Solicitor, Borough Engineer or to supervision
of the Police Department in the absence of a delegation of authority
from the Mayor.
B. If and when approved by resolution of Council, assume the office
of Secretary of the Borough and keep all accounts and records in connection
with said office and perform all the duties of Secretary of the Borough.
If the Manager also serves as Borough Secretary, he shall not receive
any additional compensation therefore.
C. Recommend to Council the hiring of any employee and, when necessary
for the good of the Borough, suspend any employee under his supervision,
subject however, to review by Council within 24 hours of the incident;
provided, however, that persons covered by the Civil Service provision
of the Borough Code shall be hired, suspended or discharged in accordance
with such provisions; and, provided further, that the Manager shall
report, at the next meeting thereafter of Council, any action taken
by authority of this Subsection.
D. In cases of emergency or special need therefore, the Manager shall
have authority to hire temporary employees to serve for the duration
of such emergency or special need or until action to the contrary
shall be taken by Borough Council.
E. Recommend to Council wages and salaries of all personnel under his
supervision.
F. Prepare and submit to Council by November 1 of each year a proposed
budget for the next fiscal year and an explanatory budget message.
In preparing the proposed budget the Manager or officer designated
by him shall obtain from the head of each department, agency or board
or any qualified office thereof, estimates of revenues and expenditures
and such other supporting data as is required. The Manager shall review
such estimates and may revise them before submitting the proposed
budget to the Council.
G. Be responsible for the administration of the budget after its adoption
by the Council.
H. Develop, in conjunction with the preparation of the annual budget,
long-range fiscal plans for the Borough, such plans to be presented
annually to the Council for its review and adoption.
I. Hold such other Borough offices and head such Borough departments
as the Council may, from time to time, direct as permitted by law.
J. Attend all meetings of the Council and have the right to attend meetings
of its committees with the right to take part in the discussions.
The Manager shall receive notice of special meetings of Council and
its committees.
K. Prepare the agenda for each meeting of the Council and supply facts
pertinent thereto.
L. Keep the Council informed on a monthly basis as to the conduct of
Borough affairs; submit periodic reports to the Council on the condition
of the Borough finances and such other reports as the Council may,
from time to time, request and make such recommendations to the Council
as he may from time to time deem advisable.
M. Submit to the Council, as soon as possible at the close of the fiscal
year, a complete report on the finances and administrative activities
of the Borough for the preceding year.
N. See that the provisions of all franchises, leases, permits and privileges
granted by the Borough are observed.
O. Employ, by and with the approval of the Council, experts and consultants
to perform work and to advise in connection with any of the functions
of the Borough.
P. Attend to the letting of contracts in due form of law, supervise
the performance and faithful execution of the same except in so far
as such duties are expressly imposed by statute upon some other Borough
officer.
Q. Be responsible for all accounts payable and receivable; in this respect,
see that all money owed by the Borough is promptly paid and that proper
proceedings are taken for the security and collection of all of the
Borough's claims.
R. Serve as purchasing officer of the Borough and purchase, in accordance
with the provisions of the Borough code and any other applicable law,
all supplies and equipment for the agencies, boards, departments and
other offices of the Borough; shall keep an account of all purchases
and shall, from time to time or whenever directed by the Council,
make a full written report thereof. The Manager shall also issue rules
and regulations, subject to the approval of the Council, governing
the procurement of all municipal supplies and equipment.
S. Investigate and dispose of or designate an officer to investigate
and dispose of all complaints regarding Borough services and personnel
and report to the Council thereon. All complaints regarding Borough
services shall be referred to the Office of the Manager.
T. Enforce the ordinances and regulations of the Borough upon a delegation
of authority from the Mayor.
U. Perform such other duties as may be, from time to time, by ordinance
conferred upon the Manager.

The Council reserves the right at any time, by ordinance, to
amend or otherwise modify or repeal § 206 of this Part in
any particular.

The Mayor of the Borough is hereby authorized to delegate in
writing to the Manager, subject to revocation by written notification
at any time, any of his nonlegislative and nonjudicial powers and
duties.

If the Manager becomes ill or needs to be absent from the Borough
he shall designate one qualified member of his staff to temporarily
perform the duties of Manager during such absence or disability. The
person so designated shall not perform such duties for a period longer
than two weeks without the approval of the Council.

Except for the purpose of inquiry, the Borough Council, its
committees and its members shall deal with the administrative service
of the Borough solely through the Borough Manager, and neither the
Council nor any of its committees or any of it members shall give
orders, publicly or privately, to any subordinate of the Manager.

The positions of Secretary and Treasurer for the Borough of
Hamburg shall and are hereby combined so that the same individual,
when duly authorized and appointed by the Borough Council, may hold
both positions.

The position of Secretary-Treasurer shall receive such compensation
as Council shall prescribe.

The duties of the Secretary-Treasurer shall consist of all of
the duties previously established for the individual positions of
Borough Secretary and Borough Treasurer and shall include such other
duties as Borough Council may prescribe under the law.

other and further steps in court or elsewhere as may be necessary
to carry out the provisions of this subpart.
