The Director of the Law Department shall be the City Attorney.
The City Attorney shall have been duly licensed to practice law in
the courts of Missouri for a period of five (5) years prior to the
time of his/her appointment and shall also be a member of the Bar
of the United States District Court for the Eastern District of Missouri.

The City Attorney shall have charge of all litigation in which
the City is a party; represent the City in all legal matters and proceedings
in which the City is a party or interested or in which any of its
officers are parties in their official capacity; advise the City Council,
the City Manager, any commission or board or member thereof and the
heads of all departments and commissions and all other officers and
agencies of the City as to all legal questions affecting the City's
interest; and approve as to form all ordinances, contracts, deeds,
bonds and any other documents to be signed in the name of or made
to or with the City.

Special counsel may be employed to assist the City Attorney
in the performance of his/her duties whenever the Council deems it
necessary or advisable and in the interest of the City so to do; provided
however, that no special counsel or attorney shall be employed in
any case at the expense of the City except with the consent of the
Council.

The Department of Public Services is hereby established and
shall be in the charge of the Director of Public Services, which office
is hereby created. The Director of Public Services shall be a properly
qualified person appointed by the City Manager and who shall serve
until removed or discharged by the City Manager. There shall be a
Building Official, City Engineer and such other employees and engineers
in the Department of Public Services as shall from time to time be
authorized by the Council, appointed by the City Manager and who shall
serve until removed or discharged by the City Manager.

A. The following
shall be the duties and functions of the Department of Public Services:
1. The
designing, construction, reconstruction, supervision and repairing
of all municipal buildings, bridges, sidewalks, waterways, sewers,
drains, public market facilities, tunnels and structures, including
any repairs, additions and appurtenances thereto and the maintenance
of the same, unless otherwise provided by ordinance.
2. The
grading and improvement of all streets, alleys, highways, sidewalks,
spaces and public ways and keeping them open and in a safe condition
for the use of the public.
3. The
construction, reconstruction and maintenance of all curbs, sidewalks
and pavements.
4. The
lighting of public grounds and highways, the laying of conduits, the
location, direction and construction of poles and all other structures
in, on or over public grounds and highways.
5. The
granting of all permits to excavate upon any highway or public property
or to make any special use thereof.
6. The
inspection of all gas, plumbing, electrical wiring and heating equipment
of all buildings and structures within the City; the issuance of building,
plumbing and electrical permits; the inspection of weights and measures
and such other inspectional duties as may be assigned by the City
Manager.
7. The
issuance and revocation of all building permits and the administration
of the Building Code and zoning ordinances.
8. The
supervision and control, as far as the City can exercise such control,
over all privately owned or operated public utilities in the City
and the enforcement of the terms of all franchises and ordinances
relating to such utilities.
9. The
making and keeping of records of all necessary plats, surveys, drawings
and estimates and the procuring of all information and reports relating
to public works as may be required.
10. The
making and keeping of records of location, directions and depths in
connection with all underground equipment.
11. All
other duties and functions required by law and ordinance or prescribed
by the City Manager.

There shall be a City Engineer who shall be a properly qualified
person appointed by the City Manager and who shall serve until removed
or discharged by the City Manager. He/she shall perform such duties
as are required by law or ordinance or prescribed by the City Manager.
Nothing shall prohibit the Director of Public Services from performing
the duties of this position.

There shall be a Building Official who shall be some properly
qualified person appointed by the City Manager and who shall serve
until removed or discharged by the City Manager. He/she shall perform
such duties as are required by law or ordinance or prescribed by the
City Manager. He/she shall be paid such fixed compensation as is established
by law and ordinance. Any and all fees paid to him/her under any law
and ordinance shall be accounted for by him/her and paid to the City
Treasurer and he/she shall, commencing January 1, 1958, retain no
portion thereof, the provisions of any other ordinance to the contrary
notwithstanding. Nothing shall prohibit the Director of Public Services
from performing the duties of this position.

It shall be the duty of the Department of Public Services to
keep a full and complete account in a book or books provided for that
purpose of all permits issued showing the date, party to whom issued,
locations and money collected on account thereof, which money shall
be remitted to the City Treasurer when received and become a part
of the general fund. The Department of Public Services shall, as required
by the City Manager, make full reports to the City Manager showing
the number of permits issued, fees collected and amounts remitted
to the City Treasurer.
