The following words and terms, as used in this Part, shall have
the meanings hereby ascribed thereto:
PERSON
Any natural person, partnership, association, firm or corporation.
The singular shall include the feminine and the neuter.

No person, owning or occupying any property in the Borough of
Hamburg shall permit any grass or weeds or any vegetation whatsoever,
not edible or planted for a useful or ornamental purpose, to grow
or remain upon such premises so as to exceed a height of 12 inches
or to throw off any unpleasant or noxious odor or to conceal any filthy
deposit or to create or produce pollen. Any grass, weeds or other
vegetation growing upon any premises in the Borough in violation of
any of the provisions of this Part is hereby declared to be unlawful
and a nuisance and detrimental to the health, safety, cleanliness
and comfort of the inhabitants of the Borough.

The owner of any premises, as well as any occupant thereof,
if the occupant is a person other than the owner, shall have the responsibility
and duty to remove, trim or cut all grass, weeds or other vegetation
growing or remaining on such premises in violation of the provisions
of § 102 of this Part.

1. Properties within the Borough of Hamburg must comply with the provisions
as set forth in § 102 of this Part under the following conditions:
A. Any property abutting any improved property must have 100% of said
property lot in compliance with § 102 of this Part.
B. Any property abutting an open Borough street, but not abutting an
improved property, must have the first 50 feet of said property from
the established street width line as shown on the topographical map
of the Borough's streets in compliance with § 102 of
this Part.
C. Corner properties abutting two open Borough streets but not abutting
an improved property shall have 50 feet from each established street
width line as shown on the topographical map of the Borough streets
in compliance with § 102 of this Part.
D. In case any owner/occupant shall neglect, fall or refuse to comply
with the provisions of this Part, the Borough authorities may contract
to have removed, trimmed or cut such grass, weeds or other vegetation.
The property owner will be billed for each time the Borough shall
have cause to remove such grass, weeds or other vegetation in excess
of 12 inches in height.
2. Provision for 10% Penalty and Filing of Lien. Should any such bill
or bills not be paid within 60 days, a penalty of 10% shall be added
to such bill and a lien may be filed against the premises in the same
manner as liens are filed for other municipal claims.

No person owning or occupying property in the Borough of Hamburg
shall permit any leaves to be placed on a public street unless said
leaves are placed in plastic garbage bags or recycling containers
which may then be placed at the curb of the property in order to be
removed by the recycling collector on specified collection days.

Any person, firm or corporation who shall violate or fail, neglect
or refuse to comply with any provision of this Part shall, upon conviction
thereof, be sentenced to pay a fine not less than $50 nor more than
$600 plus costs and, in default of payment of said fine and costs,
to imprisonment for a term not to exceed 30 days. Each day that a
violation of this Part continues shall constitute a separate offense.
Notice to a person shall not be necessary in order to constitute an
offense.

It is declared that enactment of this Part is necessary for
the protection, benefit and preservation of the health, safety and
welfare of the inhabitants of the Borough of Hamburg.

Any property located within 15 feet from the center of any stream
bed or stream corridor within the Borough is exempt from the requirements
of this Part.
