For purposes of this division, the term "parking deck" shall mean that structure for the parking of motor vehicles owned, operated, and maintained by the City of Holland and located at the northeast corner of College Avenue and Seventh Street.

No person shall cause any vehicle to be parked within the parking deck in violation of any of the following:
(a) 
In a parking space subject to a license agreement between the City of Holland and a person or entity as licensee and designated for reserved parking between the hours of 7:00 a.m. and 5:00 p.m. Monday through Friday.
(b) 
Between the hours of 2:00 a.m. and 5:00 a.m. on any day unless an overnight residential parking permit is issued and affixed to the motor vehicle pursuant to Section 18-31 et seq.

A person or entity who has entered into a license agreement with the City of Holland for a reserved parking space shall be issued a permit and a hang tag for the designated vehicle(s). A person or entity who has been issued a permit shall be required to attach the hang tag on the vehicle(s) rear-view mirror during the hours of 7:00 a.m. through 5:00 p.m. Monday through Friday and shall park the vehicle(s) in the designated parking space subject to the license agreement. A person or entity shall not allow any vehicle(s) to park in a reserved parking space except as designated in the license agreement. The permit issued by the City of Holland shall be nontransferable.

Each person or entity entering into a license agreement and issued a permit under Section 18-44.3 shall pay a fee as established by a resolution adopted by the City Council. The permit shall be valid for a period of 12 months or such term as established by the Downtown Development Authority.

The City is authorized to deny renewal of a permit to a person or entity for noncompliance with the provisions of this division.

The Downtown Development Authority, or its designated representative, shall be the enforcing officer relating to the provisions of this division for permit issuance. The Chief of Police, or its designated representative, shall be the enforcing officer for violations of parking, vehicle locations, length of parking, and improper or unauthorized display of a permit.

A violation of this division shall be deemed a civil infraction, and the fine for such violation shall be as set forth in Section 18-49(e) of this chapter.
